I also recieved a summons letter from Hanna's office stating that they would garnish my wages if I don't pay. It had several spelling errors and was not professional looking at all. How should I procede? Should I write them and request proof that they are representing Capitol One or should I call Capitol One directly? I'm at a total loss and I'm not going to let these guys get over on me. I will fight it in court if I need to. Has anyone else settled this without going to court? Please help!

My husband has private loans with Sallie Mae. He is set for Judgment on 03/24/10 and will appear. He tried to get into a reasonable debt repayment plan but Sallie did not agree. My question is, we filed a joint tax retun and the refund is due in the beginning of April. If Sallie gets a judgment, can they intercept the federal tax refund without going to court and getting a citiation to discover assets, etc? I think he will try to see if he can get a court ordered repayment plan out of this. We don't know what else to do.

I received 2 summons for Gurstel Staloch for 2 old Capital One accounts. It says i have 20 days from when served. The date stamped on the docs was not the date i got served. How do i prove serve date? I contacted them and they indicated i could set up some kind of stipulation of judgement with them basically a 24 month payment plan...it sounds weird to me...what does this mean? They indicated that if i answered the complaint and it went to a judge i would lose because the "i don't have the money" defense is not good enough i have to have a reason like terminal illness or identity theft.

how do i get a hold of creditors when i have no idea who they are? how would i get that information?
