Hess Kennedy Receivership Redux

If you recall, Hess Kennedy began a full frontal attack on the manner in which Chase Bank, Capital One Bank, Bank of America and Citibank advertised, issued, billed, and collected their credit cards. The strategy was to use the Fair Credit Billing Act and the Common Law to place the accounts in dispute and then sue the banks and their debt collectors when they violated the law.

 

How do you calculate charge-off date?

Playing the game of chicken with BOA. Trying to get their settlement offer as low as possible and so I am trying to take the negotiation right up to the charge-off date wire. As I understand it, BOA will charge off my debt after 180 days. How exactly is this calculated? I will miss my sixth payment in early march. Is it 30 days after that, or is the date my sixth missed payment is due my 180th day? As, always any advice is appreciated.

 

Now what do I do?

I have called Discover and offered 20% they of course said no. But they said it was because there are cash advances. Balance is 13k they would take little over 6K. That is about 47%, should I wait, will they offer anything better? Do the settle for less when you have cash advances? Also called NCO there offer was 50% and Portfolio 50%. I don't want to settle them at 50% if they are going to give me a 1099 I want to give them less then more right now. So should I call them again? Accounts are over 2 years old now.

 

Received statement after bank of america settlement

Has anyone else run into this? I settled with Bank of America in Jan, made my first payment of 4, and just received a regular statment where they deducted my first payment from the total balance. I have a settlement letter. Is it just an accounting mixup?

I sent a ACH revocation letter to mypaydayloan.com a few times, then eventually they came back with this. Is there any validity to any of this? Any advice on what I should do now? I am in NJ.

I am trying to get a home loan and I have been informed that I need to have a credit card from a major company (Visa, Master Card, AmEx...). Now I do NOT want to get a credit card....AT ALL, but I have convinced myself that I should. What I want to do is get a secured Master Card or Visa and use it once a month then pay it off. Now what I am looking for is a company that offers these cards and that also reports to the big three (equifax, trans... you get the idea) But doe not show on the reports as a secured card.

Mycashnow threatening to file charges against me.

Ok, so several months ago I took out a $500 pdl with mycashnow.com. Then before my first payment was scheduled i lost my job and was not able to make any payments. I took advice from this forum and sent them a certified letter saying that their loan was illegal in my state (PA) and that I would not pay any fees or interest but would pay the principal. I asked that all future communication be done through mail. So I sent that certified they recieved it and I havent heard back since. Until today when I got a call from an Indian gentleman named "John".

How do you think this new credit card law is going to help you? Is it really going to protect us consumers or just another scheme to benefit the lenders and creditors?

 

Story about a debtor trying to get debt free

I have been studying this forum and have decided to join you brave souls in your debt settlement processes. I would like to share my story as it develops in the hope that I will also be able to help others down the road. I have a lot of business debt due to the real estate crash in Florida. I am no longer there, my business there was closed in 2006. I have recently opened a new business back home that is barely making it but I can at least afford to pay my utilities and basics. I have treaded water these last few years and made minumum payments on everything up until this Jan.
