I've done some research online but am still a bit confused. Hopefully someone can help me. On my credit report, there is one account that was sold in 12/2006 to a collections agency who is now attempting to sue me (however, their representation recently filed bankruptcy so i'm not sure what is going to happen). My claim has always been that the SOL has expired, therefore it's a time-barred debt and I cannot be sued. The last payment, according to my credit report, was March 2006. Forty-eight months of payment history is listed on the credit report.

Graduating and voluntarily repaying, I continued graduate school under deferment. Subsequently, discontinued payments, supporting grandchildren, but NCSEAA sold my loan (package), after 120 days, default. Since, no longer concerned, NCSEAA told me to borrow the money and pay off loan, their logic was it's cheaper than the 25% fees they'll get if I don't.

Sorry , cant login again: I received an e-mail from them saying it is urgent I contact them and take care of my account. It says the calls wont stop until then. What is your suggestions on this. Should I just continue to send my letters to them, and file complaints again. I just wonder if I try to contact them it may get ugly. When I login in and offer a settlement it denies it and counters with saying I owe way more than I really do so it wont accept my $300 & $200 that I really owe. So I feel that part is a waste of time.

I got a dunning letter from a lawyer in my state stating that they have been retained by a CA to collect on a debt. I have never got anything in the mail from the CA previously, so I responded with a timely DV to the law firm CMRRR. I got the green card back and a week later I pulled my EQ report and saw that the CA was reporting on there. I dispute with EQ and it comes back verified and was marked that I dispute the info.

 

Can I afford not to pay a debt?

I have a debt of $20, 000 with Amex. I have defaulted on it two months back after they jacked up my interest rate. Amex is now calling me day and night. However, my idea is to avoid paying them as long as I can since I have other pressing issues to take care of (buying medicine for my ailing child). So, I am avoiding their calls. My question is, can I afford avoiding this debt? What would happen to me if I don't pay? Thanks, Megan

Ok, I am back. It's been a few months and I am almost there. Since my last post I have paid off three hospital bills, and one credit card. I am still fighting with two collectors. I started paying all these debts February of 2009, except the one i'm questioning now, and am doing good. :) Here 's the deal: I went to court on a credit card debt in August 2008. since I didn't know my rights at the time, I agreed to payment arrangements in the amount of $30.00 per month. At first the lawyer refused, so I was smart enough to say ok, then we will let the judge decide.

This company says they are from CA. called me and said I owed $595.00 from March of 09 . They will not even send documents to show when the loan started. They said I was to be arrested and fined $ 5800 .

They use it for collection and agents will call neighbors and relatives from this info: yes, there is a lexis report that gives detailed info on you and also on your neighbors and relatives. this is one reason I talk to creditors and collection agents I am trying to settle with and don't ignore.

 

Has Anyone ever sued a collector for FDCPA violation?

I'm curious because I filled out some paperwork with a lawyer regarding a debt collector and this time the lawyer said I actually have a case. I'm just wondering how all this works. I'm actually worried that they debt collector will influence the creditor to sue me in return. I wouildn't normally pursue this but the guy actually called family members of mine in an effort to shame me. That was kindof the straw that broke the camels back. Sorry to ramble but I'm just hoping someone has been there done that. Thanks!
