I have a question. My mother received a call from Oliphant last week. They stated she owed money from 4/2006 and as of 3/2009 it was being reported on her credit report. It is for a MasterCard that she was never aware she had. She asked why they were just contacting her now and they stated they were unable to find her until now. She has lived at the same address since 3/2005 and had the same phone number since then as well. Also, she requested that they send her a copy of the receipt with her signature on there or proof of a purchase. They stated they could not provide her with that.

I am preparing some DV letters to mail out. I have so far opted to keep it very simple....the body of the letter currently reads... To Whom It May Concern: I am writing in response to a letter received from you on April 20, 2009. Be advised that this is not a refusal to pay, but a response sent pursuant to the Fair Debt Collection Practices Act that your claim is disputed and validation is requested. Should I be more specific in detailing what "validating" means? BTW...what exactly are they required to supply for me?

I had my trial as a defendant in a debt collection case today and the judge said he would be making his decision in 5 days. The judge told the plaintiff (CA) and myself that we could submit statutes and case law for his review within the next 5 days. I am wondering if anyone knows what this is or how and where I can find it?

I just recently sent out a DV letter to a CA. The letter was sent out within the 30 day period and certified but when the green signature card arrived, it was not signed. Is this still valid? Please advise. Regards, Joe

Does anyone have recommendations on the best way to dispute check guarantee companies. There is one on my credit report as a charge off/collection Can I send them a DV letter/is this considered a collection company or an original creditor Thanks!

I am actually going crazy trying to figure this all out, I have talked to several companies, yeah they all sound good, but I'm scared to death to do a debt settlement even though we need to. I went with another company a while back and it was a total ripoff, I did manage to settleup one cc.
