Can we be sent to prison for not paying debt?

 

Using multiple credit cards before filing Chapter 7

I thought this was interesting. On my 1st meeting with a potential lawyer, he said that you can actually use your credit cards up to around 500 within the 90 days before filing for your Chapter 7. Of course, it has to be for "living" expenses, not luxury type expenses (expensive items or eating out at expensive restaurants). I know many that actual stop using the CCs altogether so there are no issues when it comes time to filing. I thought the limit was $500 "total" across all credit cards but apparently it's per account (lawyer's claim).

 

Chap 13 and student loan

I have private student loan debt of 330k. I have them in forbearance right now and have talked to a lawyer about chap 13 so I can get on a reasonable payment plan. Right now my payment is 2500 a month, but my monthly pay is 2000. I dont even make enough to pay this and thats not even including 50k in credit card payments that i have been paying on or just reasonable other expenses (clothes food housing). With that said, My lawyer and I are going to file an adversary to see if we can get some of this discharged.

 

Phony Summons From Mann Bracken LLP?

I had received the initial letter from Mann Bracken LLP informing me that my account had been listed with them for collection. I sent them a DV letter, CMRR, and heard absolutely nothing back from them. Today, (about 90 days later) I received a "summons" from Mann Bracken LLP, delivered by a police officer. The document I received was questionable at best to being a valid court summons. My reason for that are as follows... 1. They are listing Citibank (South Dakota), N.A. as the Plantiff. Citibank discharged this debt in 2007 after 180 days of delinquency.

 

Recieved Settlement Agreement from States Recovery Systems - HELP!

I went threw the process and sent this States Recovery Systems a settlement agreement for 40% of what was owed. They contacted me via phone tonight and said they recieved the settlement and could only do a 50 % settlement which i am not against. The debt has not been reported to any agencies as of approx. 30 days ago. My agreement stated that any negative info would be removed etc. any balance wouldn't be sold, etc. They say nothing has been or will be reported if we can get this done by the end of the month. I spoke to the supervisor and he faxed me a settlement letter.

Any help you can give would be great!! List the companies you have the loans with and whether it is a store front operation or an internet operation. Loan Shop Online Itsmypayday.com both internet operations List the original amount of the loan for each account Loan shop online: three loans. balances are as followes: $50.00 85.00 300.00 It'smypayday $500.00 I'm not sure of the original amounts as I have renewed and renewed.

Has anyone heard of debt resolution advocates? are they new? on their website it doesn't state how long they have been in business.

 

Which way is faster to repair my credit?

Hi everyone, Is it faster to repair my credit by paying off one small thing per month or by having a credit repair type thing where I make one payment to the company per month and they disperse the money? Your input would be greatly appreciated. Thanks so much!

 

Debt Settlement or Hardship Program

My hubby and I have about $20,000 in unsecured debt. We have been making the minimum payments on our CC's but after this month it is going to be almost impossible to continue doing so. We also defaulted on one personal loan. We consulted with CCCS last month and the DMP they offered would not help our situation. The reason it would not work is because the interest rates they could offer us were not any lower than what we currently have. So now I am thinking debt settlement.

 

dropping positive accounts

I paid all my student loans exactly ontime, finishing in 1997. in 2007, they dropped offmy credit report, and my score dropped, the reason listed was "lenght of credit history". How can I get back the positive history? Why should I be cited as having a short credit history in 2007, when paid loans from 1987 to 1997?
