SOL Question

A Collection Agency suing me for a credit card debt sent me a copy of a cardholder agreement. The cardholder agreement says that the agreement is governed by applicable Arizona and federal law. (Bold print) Can anybody tell me what that means? Arizona SOL for collecting on credit card debt is 3 years. I don't live in Arizona but can I use the Arizona SOL here?

Please help! I had an auto loan that was pretty much paid off...had some late fees and interest that accrued to the end of the loan - less than $1700. I lost my job and couldn't pay. Wells Fargo was willing to settle for $750...obviously...no income...no payment...I still have the car. Account was written off and sold to a CA (can't remember name). I requested DV - never received... NOW Arrow Financial is trying to collect.

A person came to my home with papers not in any envelope asking my son if Pat (deleted for his protection-Frogpatch) lived here, I asked what he wanted he said your being sueid I asked by whom he said I dont know When I refuse the papers he threw them on the ground, The date on the papers is 11/18/08 filed 01/09/09 I got them 01/28/09.

 

Hired an attorney...now what?

I recently retained an attorney to help me in a case involving a lawsuit for an old alleged credit card debt. I had answered the summons/complaint in the allotted time, was assigned a pretrial conference date later this month. I called an attorney who's name I got from the naca.org website. He told me to send him all of the paper work and a check for 1/2 of the amount that he'd charge and he'd look the materials over and contact opposing counsel. He told me over the phone that he's had successful dismissals of cases like mine as well as settlements to avoid going to court, etc.

 

Boy you guys sure did call it! I can't even believe it.

I get a message friday around 10 am from "Ms. Jordan" from H/P capital. Now I don't know which payday loan this is for, I still have 4 of 7 outstanding to their calculations. I'm thinking it's Payday Loan Yes, but not sure. On the VM she states that she's looking over this case for Indianapolis, and she has reviewed it herself and if I didn't call by 3 pm "bad things would happen" I didn't call her back of course, then my sister calls (and I didn't list her as a reference, she lives in Ohio) same lady leaves her a message stating she w/ legal dept.

I'm not sure where to start. A sherrif just came to the door this morning and served me a civil suit from Discover by way of a Collection agency law firm Smith Debnam Narron Drake Saintsling & Meyers. What do I do? I have not VD the debt yet. It's about 18 months old. There wasn't a validation noticed attached, just a lot of legal paper, the summons on the front with a file no xx CVDxxxx on the upper right corner. We live in NC and moved 7 months ago from the county that is stated. Do we have to go to Union county to go to court- 4 hours away?

 

my default loan

I have a loan that is default and it has been in default for 2 years. I recieved a letter from direct loans saying they could garnish my wages and so on. I just entered into a program to start paying on it. I was wondering if I file will they take my taxes?

 

Sworn Denial

Will taking out a sworn denial automatically delay action in a civil suit, or is at the judge's discretion to settle the matter on the spot? Also, if you know you really do owe the money and take out a sworn denial, are you commiting perjury?

 

Settling on your own

:roll: I'm seriously considering signing with Financial Solutions Legal Center (comments on this co are welcome). I've been reviewing the contract and payment layout. What if I were to use the money I would pay them each month and start paying off my cards 1 by 1? I have 7 and a total of around 73k debt. I guess I'm looking for the benefits of using a settlement company vs. doing it on your own.
