Lawyer collecting on behalf of client PDL company

18 years 3 months ago
I received a letter from an attorney trying to collect on behalf of their client (PDL company). So I sent a DV letter and received nothing. A couple weeks later another letter from same attorney with different address came and I again sent DV letter stating this time that lawyers have to follow the same as debt collectors when trying to collect debt. Now I have the money to pay this, but they never really stated that they own this debt. Should I pay the original PDL company or the attorney???

LVNV in Texas

18 years 3 months ago
Can someone help me with a few things in Texas? LVNV has filed suit on an old Sears account. In my answer to the summons I brought up SOL ( Close if not already expired ) I also brought up the fact that one of the requisites listed in my county for filing suit was that the plaintiff is to send a Certified Demand Letter and if money is not received within 10 days suit may be filed.I did not receive any such letter. Suit was filed in JP court where Rules Of Evidence & Texas Rules of Civil Procedure are in effect.

I saw this article on The Consumerist and thought someone may be interested. New Hampshire Gives Payday Lenders The Boot New Hampshire will become the latest state to keep payday lenders from gouging their patrons. A measure passed by the legislature will cap interest rates on payday loans at 36%, a drastic change for an industry used to bludgeoning under banked consumers with interest rates exceeding 500%. Payday borrowers spend an average of $793 trying to repay a $325 loan.

Help me out here

I received a letter from debt collector smith, haynes & watson and they are collecting debt on a PDL from Netcash USA. I have made numerous attempts since July and never received a response. Now it appears they have turned it over to a collection agency. I had paid them well over what I should have. 810.00 on a 300.00 loan. Can you please let me know what I should do next? Thank you all for all of your help.

JCEMT, I used your validation template but...

18 years 3 months ago
what if the CA's I've sent this letter to does not provide me with the validation requested? What is considered sufficient proof of validation in a court of law? By reading many many posts at this forum, I understand that it's unclear [by law] what actually constitutes proper validation, but, how can I be certain what IS sufficient? Is it at my discretion, their discretion or the judges discretion (if it would go that far)? This is a subject I am very confused about. Thanks for any and all responses.
