:twisted:What are the laws for the state of Texas for a payday loan establishment to seek after you with a private locator and serve you a summons to appear in court and try and file charges of theft by fraud of check on a payday loan check, and is this illegal:confused:

to make a long story short. I was unable to pay and closed my account. then managed to pay 4 more payments that month and the next in January of 2009. There was a charge off a year later and now I am being sued. Through Credit Solutions 3 offers were made to settle with them(Zwicker and Assoc.) Discover's in house collection lawyers. I answered the summons and the case management statement. The Senior Legal Center in CA asked twice for a settlement Conference with no answer. Do you have any suggestions at this point? Bankruptcy is out of the question.

I live in Fla. and got a threatening phone call today that VIP Loans is going to start garnishing my wages. I was wondering if this was legal. The debt collector told me he was going to call my job and verify my employment. Can they really do this? He told me it was stated in the Terms and Conditions, that I really didn't read. I only borrowed $300.00 and now I have to repay $500.50. Is this legal or just a scare tactic?

I just wanted to say thank you to everyone. I had gotten myself in over my head with 5 payday lenders. Over the course of 2.5 years I had taken out $10,000 in loans from PayDayMax.com and paid them back $14,500. I had a current loan outstanding of $1410, with payments scheduled for $409 every two weeks. I had 4 more, all of which I had been borrowing and paying back for about 2-3 years. I followed the step-by-step instructions, and so-far-so-good. I closed my Bank of America Account, and then e-mailed USFastCash, United Cash Loans, My Next Day Cash, and CashJar.com my C&D Letters.

I have received a call from a company called Capital Harris Miller and Assoc stating that they will serve me unless I put a prepaid debit card on file with them and setup payment arrangements....for a VIP Cash payday loan from last year. Im from California. So to give me time to do research on them, I asked them to email me proof to validate that they really own the debt .
