Hi
We know that the business of FDCPA laws by a CA results legal action and the consumers can file a class action lawsuit against them.
So what happens when there are shady collection agencies like Allied Interstate Inc still in business? They call people endlessly without any details of the debts and show rudeness. They go against the Mini Miranda disclosure as mentioned in Section 807(11) of the fdcpa. The company is also famous for false representation of the accounts. You can be forced to pay some unknown account because of their wrong contact. Remember, "Allied Interstate" can be sued up to the $1000 depending upon the extent of damages.
I read many of you being victimized by this collection agency. Use the federal laws as a protection against such shady collection activities. Report them to the FTC, BBB as well as the State Attorney General office.
How many of you want Allied Interstate Inc to undergo legal actions. I am thinking of consulting an attorney and put a legal fight against them. I will like all of you to post your experiences here so that it can be documented. After browsing through this forum thoroughly, I picked some threads of their illegitimate business.

  • The illegal activities of Allied Interstate. The poster in this thread said that the company wanted to settle the matter without any documentation. This is illegal.
  • Allied Interstate making threatening calls to the family members. It is illegal as per the FDCPA laws.
  • Here is an example of Allied Interstate not identifying them and making regular calls at work.
  • This collection agency uses profane language and gets in contact with the wrong person.
  • Allied Interstate will try to force you and make a payment on the debt that is past the SOL period. You are under no legal obligation to pay the debt if it is past the SOL period.
  • One more thread about the misdeeds of Allied Interstate Inc.
  • This company does not identify properly while leaving messages on the phone. They keep calling endlessly.
  • Allied Interstate never stops. They contact persons who do not owe any money.
  • Allied Interstate reviews the credit reports without permission.
  • A thread on bombarding phone calls done by this collection agency.
  • Threatening calls starting from early morning and ending just before 9.
  • Allied Interstate harassing whole year
  • Here is the contact address and phone number details of Allied Interstate Inc.
  • Calls get disturbing for someone not related to the accounts.
  • People are getting fed up with allied interstate and their calls. No phone numbers, no e-mails just mailing address but not sure whether it is proper or not. Contacting them is really tough.
  • Confusion is still there on LVNV Funding and Allied Interstate.
  • Allied Interstate Inc not following up with the cease and desist letter.
  • Getting empowered on how to deal with Allied Interstate.
  • Harassment with "person to person"

A new thread on Allied Interstate contacting a wrong person.

I sent a cease and desist letter to Allied Interstate. The phone calls stopped for a year and now they are calling 3 times a day not leaving a message (3 x on Easter Sunday). So much for the letter. The number they call me from is 877-642-1263. And they are nasty to talk to and they do want payment like right now and told me to whip out my debit card and pay for it. So I don't know if you can rid of them short of suing them.

Who are you the president of Allied Interstate? or the girlfriend of one of the owners? You obviously have not gotten messages froom Allied (or perhaps you are the ass who calls Allied)...I have received messages for 1 month- the person they are looking for is not me and they are rude and persistant. I have filed multiple complaings on this company. Including a cease and desist letter.

Keep your comments to yourself, Allied is the DEVIL (but not quite as competent as you say)!!!

Allied Interstate called me today regarding a $300 store-front PDL I took out in Oct '01 in California. I moved to Ohio in 2005. My check I had written to Advance America bounced (per the rep I talked to at corp hq of AA), then they sold the debt to Paragon Way in Aug '06 for $275. Now AI has it. They must have gotten my cell # because I filed Chapter 7 bankruptcy last month, and that's public record.

The SOL I need to worry about, is the one in the state I now reside in, right? I signed the contract on (Mon.) 10/22/2001, and the repayment date that they would have deposited my check would have been either 11/2 or 11/9 (my next payday, don't know which date). My check bounced when they deposited it. Does anyone know which of the following pertains to my situation?

Written or oral account: 6 years, (O.R.C. ?2305.07).

Written contract: 15 years, (O.R.C. ?2305.06).

Oral contract: 6 years (O.R.C. ?2305.07).

Note payable at a definite time: 6 years, (O.R.C. ? 1303 .16(A)); (2)).

Demand note: 6 years after the date on which demand is made or 10 years if no demand is made and neither principal nor interest has been paid over that time (O.R.C. ?1303.16(B)).

Dishonored check or draft: 3 years after dishonor, (O.R.C. ?1303.16 (C))

allied interstate does not sue anyone, the banks they are collecting on behalf of do, they always put the mini miranda in letters and they do not need your permission to view your credit report when you sign the agreement with the card company u are agreeing that if you do not pay this then they will come after you for the money you are then giving them concent to call you about that matter

They call me from 866-898-3991 for someone named Larry something, and my numbers are on the do not call list. Since they are calling people who are on the do not call list I for oine plan to launch multiple repetitive fax calls to their toll free voice numbers which they
call me from. Guess they could complaiun about that, but my position is that I am merely responding to their calls. Wonder what they would do if everyone with complaints againswt them started sending faxes to their voice toll numbers, especially during the daytime.

If you were really fired (which I truly doubt) you need to contact a consumer attorney to file for damages and a employment attorney for wrongful dismissal. No employer is going to risk firing someone for what could be a crank call. Either that or they where looking a reason to fire you.

The Department on Education, and its collectors, do NOT require a judgement to issue an order of garnishment or tax offset withholding. They can't just take money from your account, you have to set something up for that, but they do have the authority to issue an Order of Withholding without a court order (trust me, I just got mine resolved after almost a year of fighting).

Now I am out of a job. Because of the calls and threating me. I have filed a complaint letter and
it was mailed today. What else can be done.

Wow a representative from the ACA contacted me today regarding my complaint against allied interstate. I guess they do take complains against their members seriously.

I have always paid my bills on time and took advice my grandmother. If you make 20K a year live like you only make 15K. If you make 90K live like you only make 67.5K. That way you always have enough. Collections is necessary for companies. Now while that it is important it is also unnecessary to engage in activities that break FDCPA guidelines, like "saying" i am a contact when i am not just so they can leave a collection message to a 3rd party? They lied to me about that and it is wrong. Especially when i have notified them in the past. They have a bad rating for a reason.

When i was a collector, i did call people at casino's before where based on charges i suspected they would be there. I never disclosed to a 3rd party when calling there but just asked for the person and many times they would come to the phone. They would be pissed but hell if you owe money you should not be at a casino.

Bottom line while i don't like debtors that cry about getting calls when not because of job loss but just because they spent money like crazy and now don't want to pay, Collection agencies don't have to break the law. You want to call me looking for a phone number for a person, fine but that is different from telling me they owe money.

Hello
I am dealing with Allied Interstate regarding defaulted student loans. I have been in default for about 2 years due to not being employed. I have on several occasions file for forbearance and I was granted until that option was no longer available to me. Once my loan had reached a collection agency called Delta. I then filed for a hardship which that was also granted. Now my loan has now been forwarded to Allied where as I have received continous rude behavior. After finally speaking to a mgr. I was granted for a hardship which was 50.00 monthly which I was told was the lowest amount that could be accepted. I then called to set up a payment schedule which was going to be on the 8th of every month starting in March 2010. I was told that was not acceptable due to that date being 37 days away and she stated that she was going to forward my account as a refusal to pay resulting in wage garnishishments. My financial status is only bi-weekly unemployment compensation .Would you please tell me who I should speak to in recards to this matter. I ask for some form of verification in writing of the amount that was being asked for which was $50.00 monthly and I received nothing. I want to find out is the amount legal and is it going to be applied to my bill
Thank you

The reason they ask for your number is because they don't have caller id. So if you call them back they need either your account number or phone number to find you. You don't call your cellphone company up and say this is XXXX and expect them to be able to find you. Why would you expect anyone else. It's really sad because a lot of people skip out on their bills and collection companies have to find them. To do this they will call their mom, ex girlfriend, employer, and etc. Don't get mad at the bill collector get mad at the person who didn't pay their bill and if it is you pay your bill.

Now they shouldn't be calling if you ask them not to call. They may call 5xs a day if they get the voicemail every time. Easiest way to get them to not call 5xs a day is to pick up the phone. The phones are on a dialer ( a computer dials the numbers) since there is a delay between when you pick up and the dialer lets them know you picked up they say hello? to ensure you are home.

But contact your attorney general if they are truly harassing you.

I'm glad to know I'm not alone. Allied Enterstate is a snake pit.
"Marlon" begin calling me at work beginning July 14. Our secretary made it clear that he was not to call my place of employment. He continued to call three times a day. Then on July 17 my boss received two messages on his machine at home. Now I'm pissed. I call "Marlon's" number and guess what "Dane Wright" is on the answering machine. I hang up. "Marlon-Dane" calls me back. I talk to "Marlon-Dane" telling him he is harassing me and under no circumstances should he call my boss or call my office.

I ask for the company address, which he gave me. I had already obtained the Columbus Indiana address. I ask him why he was calling from New Jersey - an area code 973? He said (don't laugh) "That's the way the phone system is set up."

My roomate and I had a joint American Express. Each card had a seperate number. Roomate filed for bankrupty. "Marion-Dane" is harassing me to pay the amount my roomate owes. Can he legally do that? I have sent both Allied and American Express a cease and desist letter, certified mail.

Once I got over being pissed I realized that I can play with Mr. Marlon-Dane. I'm sure he would like to discuss the merits of living in New Jersey. Maybe he would be interested in the phone numbers of all the people in my city?

Thanks for listening.
B.

Key word...joint account. If one party files bankruptcy, the other takes on 100% responsiblity for the entire debt.

Legally, you can only verbally cease them from calling you at work. In order to stop any other calls, you have to do it in writing.

AM EX is very agressive in collections. The do sue.

What do you do if a debt collector reports an outstanding account to a credit report agency that does not belong to you?

I received a ltter from Allied Interstate today saying that I owe $1018.38 I knew NOTHING about this and have never heard anything before today. I called them and had a 15 minute long phone conversation... (Which went round and round in circles) They told me that it was a visa card debt from 2001! That portfolio recovery associates had just purchased from credigy receivables... They said they could settle this account today for $712.00
As I said I know nothing about this?? What should I do?
Thanks

My boyfriend received a strange letter from Allied Interstate Incorporated. It had his first name, last name, middle initial, correct birth date and correct SOCIAL SECURITY NUMBER.
The letter requests that the recipient call back and provide the following alleged information about my boyfriend:

Inmate ID number:

Date of arrest:

If released, date of release:

Parole officer: ...etc.

My boyfriend has never been in any kind of legal trouble/arrested/in jail. I immediately became suspicious of the letter, googled Allied Interstate, and discovered they are a collections agency. He recently changed some account activity with his student loan and we are wondering if it is somehow connected, but all of his debt is under control.

I think it's asinine that the company sent a letter to scare the recipient into responding by implying they were IN PRISON. It is disgusting that they would prey on innocent people in such a way. I can only imagine how someone might react if they didn't realize it was a scam. We plan on sending the cease & desist letters, and requesting validation of the debt. I only hope they haven't actually reported a false claim on his credit report.

Allied Interstate Collection uses an automatic call system with a recorded message and calls me every day now for over a month! The message rattles off some kind of phone number which I have never gotten clearly. My voice mail often shuts off before getting whole number. They are trying to contact my son who lost his job this summer. If a human being would call me, I could tell them my son is now living with friends and has no phone or permanent address. I am just his dad, so I wish they would stop punishing me with daily automated phone calls!
Warmly,"Just Dad"

The address I have for Allied Interstate, INC is: 435 Ford Road, Suite 800 Minneapolis, MN 55426-1096. The phone number is : 800-367-1822. They have harrassed me about a loan that I owe, mostly calling my cell making threatening comments. It is totally ridiculous. I'm going to send a cease and desist letter and see how that goes.

This is there student loan office,. Cease and desist them and you will have them garnishing your wages pretty darn quick without a court order. Dont mess with federal student loans...they will find your employer thru the IRS.

Allied called me this morning and I pretended that I wasn't "in". The lady on the end gave me a 800 number (18002145305) and said it was her direct number. She later said that there was a case number in some county I've never heard of. The case number had the last 4 of my social! She said she couldn't tell me any more because it would jeopardize her client's case.

I have a default on a car I bought that they repossessed and sold and applied the money from the sale to the balance which leaves about half the balance. I did a credit check and the report claimed the car company "wrote off as bad debt".

Is Allied Interstate for real then? I didn't catch the County name of the case # so I can't search the Court System. Should I be expecting to be served in a County I don't even live in? Is that even legal? I mean I know I owe on the car, but I'm on social security and live with my parents. Can they garnish Social Security income?

Any help would be appreciated.

Allied Interstate has been calling our house looking for a joshua but they don't give a last name--which is fine--but they keep calling and calling all day and even in the night--to collect a debt from someone we don't know--. i called them back at the number that shows on my caller ID 775-319-1506 and spk with a mark gutierrez and he says he will take our number off--we will see--
he was rude and very nasty to me when I called to tell them that they were calling the wrong number. He told me that I needed to respect his employees when I called them--I told him that he needs to make sure they are calling the right number and to respect the person they are calling --especially if we tell them that they have the wrong number. This is ridiculous and it seems like something should be done --but who do you go to!

I have been getting calls for a few months now. It is always a recording. A man with a very creepy voice says "...in regards to a debt. In any information, pain will be used for that purpose". A few times I thought I might be hearing it wrong, but my fiance listened and heard the same thing. I tried to call back a few times, only to get hung up on when I questioned their integrity. I don't know what to do. I have a digital recording of the recorded call I get! Any ideas of what I should do with it?

I have also been getting hit with multiple daily calls from these idiots. I set up payment agreements with them and still get calls demanding money I don't have. I finally got fed up and told them that if they called me one more time before the payment date, that I would withdraw my authorization for the payments, file a dispute claim to block them from taking payments and also file a complaint with the Attorney General. They were true to form and called me back less than 4 hours later, at which time I told them they were in big trouble because I am going to file those papers. My bank also advised me to leave them a message I wanted them to cease and desist as well as let them know that I would be filing complaints. This I have done. Like Billy Joel is fond of saying: "Don't take any s--t from anybody!"

The first thing to do is to send them a Cease and Desist Communications Letter by certifed mail. If they still call you after you get the receipt back, then file a complaint against them with your Attorney General's Office. In Arizona, you can file a complaint against collection agencies with The Arizona Department of Financial Institutions. They can take away their license to call people in the state of Arizona. The other thing you can do is record their telephone calls, tell them you are recording them, and then file a lawsuit in Federal court against them for violating the Fair Debt Collection Practices Act once you get enough evidence against them.

We'd been getting calls from Allied lately but no messages (I found out through the number on the caller ID). We thought we'd been working with Vital Recovery Services (still waiting for debt validation requested from Vital Recovery a month ago) and never heard of this company before. What to do?

They called me asking for my mom. I told them that I was the son, that she didn't live here, and ask what they were calling about. They mentioned needing her capital one acct #. I told them that we only talked to capital one about capital one. they hung up. I called back, gave them my phone # and ask again why they were calling. She said she couldn't discuss anything with me since I wasn't the account holder. I told her that since she f**king called me, we would discuss it. She reminded me she was recording the call. I said good, then you need to take any name & number that she had tagged on this account, off and stop harrassing us with her bulls**t scam & bogus scam company. she told me to watch my language or she would hang up. I told her to put someone one on the phone who spoke english. Some other woman picked up and started on me about my language. I told her the samething about the account, only cap1, don't call back, do not call others with the same last name.... She said she would disconnect it I kept up with the language. I said no, you fking called me & we ARE gonna talk about it. Told her again to stop harassing us. She said blah blah... I told her again. Then told her not to call me again from fking india trying to sell me some fking goat meat. She still couldn't hang up since I called her. I gave my # one last time and told her not to call anyone with that # or last name.
