Cach, LLC going to court
Date: Thu, 09/17/2009 - 08:25
I then just a day ago received my court date for next month.
I live in Texas. I have for verification from Cach to make sure this is my old debt and they have never responded. They have tried to get me to make a few payments but when I press them for details I never get any, so I have never paid. I would like to make sure this is actually my old debt. It is supposedly regarding a 10 year old debt that was defaulted on 8 years ago. I kind of wonder if it is out of SOL? But what is considered the last date of activity?
Does anyone have any actual experience of actually going to court with these guys? I plan to ask for verification in court. DOes anyone know what I NEED to specifically ask for? I do not have the money to hire an attorney and this is in civil court.
Any adivce and or suggestions would be great, a little nervous.
If you have not made any payments in the last 4 years, it out of
If you have not made any payments in the last 4 years, it out of SOL. They are probably hoping that you will not show up in court and they will just automatically get a default judgement. Show up for court and if you have not made any payments in the last 4 years, use SOL as a defense. Now if you have made even one payment in the last 4 years the SOL started over with that payment. The date of last activity is the when you last made a payment on the account. CACH has the burden of proof on them, they have to prove that you owe the debt and that the debt is within the SOL. I'm no expert on this, but this is what have read about, I also live in texas, and I have a debt that CACH is trying to collect on. So, I know what you are going through, except mine is not out of SOL. The thing about Texas they can not garnish you wages, they can try and go after you bank accounts if they can find where you bank at. But since yours is out of SOL, show up and let them know. If you don't mind me asking, what attorney is CACH using to sue you here in Texas?
