Need Help Dealing with Collection Agency

I have sent two pay for delete letters to Credit Adjustment collection agency on June 24 and August 3 2009. For the original amount of $399.00 They did not respond to these letters. On September 11, 2009 I received this letter:

[SIZE=3]Dear Mr…..[/SIZE]

[SIZE=3]Your account will be referred to our attorney in ten (10) days with instructions to seek judgment. If judgment is obtained, we will authorize our attorney to proceed with garnishment of your wages through your employer (they listed my employers name). Attachment of real estate and/or personal property may also be considered, if necessary, to settle this matter.[/SIZE]

[SIZE=3]Court costs, garnishment fees, attachment fees, and interest allowed by the court will be added to your account.[/SIZE]

[SIZE=3]To avoid this action, the sum of $ 420.48 must be paid to this office within ten (10) days of the date of this letter.[/SIZE]

[SIZE=3]Attorney Referral Supervisor.[/SIZE]

I then sent a Certified Debt Verification letter to them on September 16, 2009. I have the signed card back from the USPS. On September 23, 2009 I received this letter:

[SIZE=3]Dear -------[/SIZE]

[SIZE=3]Due to your negligence to respond to the previous letter sent to you by Credit Adjustment, Inc.., we have selected our attorney, Jeffrey R. Lankenau. 0034631, to file a complaint with in your county court. This appears to be the only way we ill be able to get this account paid in full. If the balance of $421.53 is not paid within ten (10) days of this letter, we will have to take action against you.[/SIZE]

[SIZE=3]Court cost, garnishment fees, attachment fees, and interest allowed by the court will be added to your account.[/SIZE]

[SIZE=3]Attorney Referral Supervisor[/SIZE]


The have totally ignored each of my request.. I didn’t sent the two pay for delete letters certified.. I wish I would have…

How should I handle this last letter I received?

They actually have done nothing wrong. They do not have to respond to a settlement or a pay for delete request. There silence was a denial of your request. When you DV'd, they were following FDCPA in that in that they informed that the account had been transfered, as they previously said it would be. They do not have to answer your DV if the account is being handled by someone else. As far as I see it, they followed the law almost to a T.

The first letter I received gave me ten days. I responded to the letter within 6 days with proof of delivery requesting the Debt verification. At this time it was not turned over to anyone else. Also if it has been turned over to another person. Why am I still receiving letters from them demanding their monies and giving me ten days to pay?

If the letter is not from an attorney they are probably bluffing. Also, what state do you live in?

If the attorney is not licensed in your state then he can't do anything. Furthermore if they threaten you with an attorney not licensed in your state then that is illegal.

It seems like they don?t have to prove anything? The pay for delete letters I sent twice shows I was willing to pay in full until they added $22.00 for some reason? Also the Debt Verification letter clearly states I am not refusing to pay the debt.

By the sounds of things...yer in Ohio.

I know of the attorney that's in that letter. I just went up against him with my own attorney. He dismissed the case right after the pre-trial.

I suggest you contact a Consumer Attorney thru the NACA website.
