Hi all! I have been following the dealing with illegal payday lenders to the 9's and today I get a very threatening email from Cash-N-Dash. It was an internet payday loan and internet loans are prohibited in my state (KY.) Here's what it says-
"Wage Garnishment Pending
You are hereby given 7 days from this notice in accordance with Section 7-5-1, Utah Code Annotated or appropriate civil legal action is being filed against you for the amount due and owning together with fees, court costs, ect... Your employer will be contacted and we will immediately seek to garnish wages.
You are currently being added to SCAN-Shared Check Authorization NW). This will permantly affect your credit rating with all the bureaas. This will immediately stop your ability to do the following:
Write Checks
Open A bank Account
Receive a Loan from A Payday Lender."

When I started this journey I confirmed through the DFI that the illegal ones could do nothing to me, ie, effect my credit, legal actions, blah blah blah.
What do I do here guys. I have nerves of steel but this is freaking me out!!!

well the utah codes mean nothing as you are not in utah.if you gave your employer a wage assignment revocation letter you have nothing to worry about.in fact if you filed AG complaints.forward that e-mail to them.SCAN is in regards to if you wrote a check.you never did with the pdl's.again an empty threat.

Just so that you know, they very well may report you to SCAN. The catch, just as Paul stated, is that you did not write them a check. Should you try to write a check at a merchant and it gets denied, they will give you a number to call for more information. When you call SCAN, inform them that they reported you with no check in thier possession. When a reporting merchant reports a bad check, they are required to provide a check number for reference or their ability to report can be revoked.

I figured they would report me and that I could dispute it but I appreciate your advice. It seems like it wouldn't be worth their trouble to make a false claim unless they are getting off on making my life heck. But it's cool, I write checks for groceries all the time so I will know very soon if they followed through on their threat.
