Shall I offer a settlement amount or wait?

Hello, To date my credit cards are current. I have an inherited annuity that will mature on Nov. 11, 2012. I am 75 and live on my SocSec. I ran up the CC debt to open an art gallery which, although the art was good, failed. My question: at what point should I stop making the CC payments to start the settlement process? The annuity will afford perhaps a 30% settlement on the various accounts. I would like advice on strategy and opinions on how things might play out. This chunk of money, left to me by my mother, is probably the last I will ever see.

I've been reading several threads on this site and I'm pretty sure my online payday loans are all illegal in Louisiana becuase none of the companies is registered here. I'm not behind on any of them, but on most I've overpaid the principal amount.

Okay, so a collections agent from Lakota Cash responded to my email and said that I owe $810 ($600 principal, $180 interest, $30 for telling them I put a block payment on my account?). She also referred me to this part of the loan document which I signed: "This Loan Contract is subject solely to the exclusive laws and jurisdiction of the Cheyenne River Sioux Tribe, Cheyenne River Indian Reservation.

Good morning. I currently have 4 outstanding internet payday loans and I live in the state of Iowa Horizon Opportunities: Borrowed $300 and have paid $540 in finance fees only United Consumer (EZPayDay) Borrowed $200 and have paid $180 in finance fees only Vista Group Borrowed $300 and have paid $270 in finance fees only US Fast Cash Borrowed $300 and have only paid $90 in finance fees only. These loans were taken out while we were struggling to make ends meet. And, then they accumulated because of the high interest fees.

Finally hit the tipping point with my PDLs where the payments due wil eat my entire check. I have 7 online loans and 6 storefronts. I am using relief.llc to handle the online ones. Mostly because I do not have the stomach to handle all of these on my own--or the time. Im in process of closing my account down and already have a new one set up. I at least stopped my overdraft protection so no more of these will get paid. In dealing with the storefronts I have a few questions. Im currently not past due on any--payments due Friday.

 

1099-A Question

I really don't understand whether or not we need to claim income from this 1099-A we received. Box 2 show 308,000.00 and box 4 shows Fair Market Value of 345,000.00. Do we need to claim, as income, the difference between the two amounts which is 37,000.00 or not?

 

Summons from Midland

I recently was summons by Midland, they apparently purchased an old account from Citi Bank. For starters, they left the summons with my 17 yr old daughter and I am not sure if that is legal here in the state of AZ. Currently they are suing me for $2,000, I attemped to find out what the SOL is here and apparently it just changed to 6 years. Which I might add would of qualified this account to be uncollectable in Sep 12. I have done some research and am not stressing out on how to respond to the summons, however I did have a few questions.

Hi, On 8/31/11, I took out a payday loan for $200 with Everest through the Internet. They were supposed to take out $230 on 9/9/11, but didn't. Soon enough, I didn't have any money to spare, so I let it go. I should've been suspicious because they never sent any paperwork....Since then, they've taken out up to $70 every two weeks. Last week, I figured since I had my tax refund, I'd pay them off. That's when I decided to do some research, and found out the whole thing was illegal in Minnesota, where I reside.

I've been toying with my options here and I'm curious to know how the bk court determines what you can pay for a chp 13. I make too much money for chp 7, and I'm afraid they're going to say I make too much for 13?? I have over 60k in credit and person loan. and 125k in student loans I make 6250/month gross I don't own a home and have no assets. I have a car worth about 9k, still making payments.
