I settled with Foster and Garber for 15,900 from the orginal amount of 29,000 and gave them 14,000 and agreed to payoff the rest. They now have taken me to court and state that I have to pay off the 29,000 plus interest. Can they do that?

I know this is a Private Student Loan. I assume it is in no way shape or form backed by the Federal System. Just wondering if this is a "non-profit" or "for-profit" loan. Can't find anything on a promissary note from 2001 on this type of student loan.

Does paying off an overdraft that is a few years old reset the clock for Chexsystems?

These guys are calling me now to collect $455 on a $350 loan that I have paid $420 on already. I can't find any other information on them at all. Their website still has "Coming Soon" under About Us. I WISH I HAD NEVER DONE THIS!!! :( Anyway, their email responses have been that they are a tribunal entity and are thus immune to any laws at all. I know, I know...whatever. So they are calling work, cell, etc...leaving messages that we need to work out a payment arrangement. What do I do? Does anyone know any more about these guys and who their DBAs are??

If you fall behind in paying back payday loans, which ones are more likely to try to bring charges...storefront or online? Also, which ones should I concentrate on the most? Thank you, Ms. B

OK so I have read all the forums but what just happened to me is just as bad if not worse. This idiot left me a 5 minute message saing "Lindsay, you live in NJ the worst state for breaking laws in the country. They will take your home, your possessions, tear up your family and ruin your job if I send this to a law firm to collect your debt".."We here at E-Payday can make your life easier of you call me now. Pay uus or the law firm we send this to will go and take the money from your bank account, from your kids mouths and tarnish any life you think you have by not paying your debts.

Anyone ever deal with them? Are they legitimate? They had 3 addresses listed for me ( indcluding one that is 6 years old)...they claim they sent a letter, never received it. The debt in question has another new CA appearing on my credit report that i had worked with. I don't know what is going on. Is it a good idea to contact the original creditor about this? They didn't want to send me a letter without setting up a payment arrangment on the phone... They also asked me if I was working....why would they ask this question?

On Jan. 31, I received a fax from ARM of FL, letting me know that they had received my complaint against Paychecktoday, whom they were collecting for. They said that since they had received the complaint, they were sending the file back to their client as a cease and desist. It then states "You will no longer receive any calls or correspondence from our office." Beginning 2 days ago, they have started calling me again. I still have their voice mails, as well as snapped photos of their number with the date and time on my caller ID.
