I have unfortunately got myself involved with multiple payday loans. Is there anyone that offers a loan that can be paid back over 6-9 months that I can use to pay them all off? I need approxmately $4500 to pay them all off. The amount I am paying in fees can easily pay off the loan in several months.

So my wife had a private student loan that she was unaware of for about $30K (don't ask me how, but she thought that she had consolidated them all, she was in school six years) - and about six months ago she got contacted by Windham about her debt. Her credit report shows that the loan was taken out in October 2004 and transferred to recovery in October of 2008. I have heard horror stories about Windham but thus far they have been OK.

Whoever said that they got served with summons, were probably one of the kids who works for the company. If company location elsewhere (not in your state) company would have to retain atty in your state to sue you or file legal action against you themselves, but it has to be in your state. You would also get served by the sheriff or special process server. If you were not served, judge would issue alias summons. If you did took a payday loan, and did not pay, then, look in your contract.

My question is, are CheckNGo places allowed to debit your account 5 times in one week, each time collecting payment? The amount that they collected was more than my weekly salary, so is there a law against this? It seems like a form of garnishment to me. I live in SC and this is a no garnishment state. Please help.
