question: Based on the FDCPA rules isn't a CA required to send a 'validation notice' w/i 5 days of first contact or even prior to contacting the cardholder? We are getting calls from Nelson Watson CA but have NOT received anything in the mail stating they are the collection agency handling our account. I've asked them for it twice now and they say it was sent the day they first called ( 3 weeks ago), I still have nothing from them.

Question: Collection agency took all money from my bank accounts which was all from unemployment compensation. I contacted the district civil court and they said to fax 3 months bank statements to the collection agency which I did. How long do I give them to return my money? What can I do if they don't return my money? I did have a court date but due to moving didn't get the summons in time. And I irresponsibly ignored following it up.

I have a credit card that has gone into collections with a firm called Frederick J. Hannah (located in Georgia) and Associates. I have paid them 625.00 since they have had my account (March/April 2010). I was told by a gentleman since I missed my September payment that if I did not settle the account this month (October) they would sue me. Keep in mind I called their firm and left a message stating I could not make Septmeber's payment and asked if someone would call me to make payment arrangments. NOONE returned my call!! Now I am scared and wondered what to do!

My last payment was May 20th 2009. They state they wrote off the account in January 11th 2010. How does cap 1 arbitration rules apply to this date? I have been summons to appear in court October 20th and cap 1 is listed as pettitioner represented by Irwin James Frankel.

Are they legal in California? If not, and I owe them money, can I just settle for the principle?

I have a original creditor that is trying to collect on a debt that was sent to collections over 5 years ago. I never received validation of debt from the collections agency and now I have a letter from the original creditor. Can they do this? I live in Iowa and I heard that the statue of limitations is 5 years for credit cards. Is this true and if so what is my next step? Thanks to any help.

I live in PA I took a LOAN from Lakota Cash for $500, I have since paid back biweekly payments for a total of almost $600, so in my eyes the principle is paid back and I don't feel like I should continue to pay them the way they want. I have closed my account and now the are threatening to garnish my pay. Do I have to worry? Can they actually do that?
