Being sued in small claims court (Texas) - anyone been there?

I have been repaying a personal loan to a former friend, but unfortunately I have fallen behind and cannot keep up with the payments of nearly $700/month. Without going into a lot of details, I know this person intends to sue me in small claims court. I am in Texas. Has anyone been sued in small claims and can you tell me exactly what the process is and what happens? Do they send someone out to serve you, or do they just mail it? Do they notify your spouse? Will the judge let you work out payments? What happens if they get a judgment? Thanks!

I have received two notoces from Northstar which also has Maorgan and Pottinger, PSC on them. Each are inthe amount of over $2,000.00. The first one was for a debt that was over 10 years old and this ones says 2007. Isn't there some type of statue of limitation of ths stuff?

I got a $1200 loan from check n go online. I was not able to pay it in full. I live in Texas. I worked out a payment plan, and I did repay $500, after already having paid over a thousand in renewals. After paying the $500, my personal situation got worse. My bank account was going negative the day I got paid!!!!!! I made several arrangements with check n go that I was not able to keep. They finally sold me to a collection agency named VCS. I talked with them on Sept 7th and made a $100 payment to them in good faith.

 

Defaulted Loan Consolidation

I am in default on two of my student loans. My wages are garnished for the past 6 years for one loan and 3 years for the other. I pay in excess of $800 per month via the involuntary payment plaln. I would like to take out a loan for postgraduate studies. How may I consolidate the two loans with that are currently in default status?

 

Pre Legal Credit Solutions/Lewis Luxenberg & Associates

I have been contacted by Mark Sloan of Lewis Luxenberg & Associates, saying they're representing Pre Legal Credit Services to recover an outstanding credit card debt. I want to clear this debt, but am not sure these guys are legit, I've also found a few negative comments on Pre Legal and Mark Sloan on this site and others. Any advice would be welcome! Thanks.

I received a call from Lombardo on 9/10 and again on 9/13. On 9/10 I sent a cease and desist for them not to reach me by phone at the office and despite that they called on 9/13. (I also FAXED a copy of the letter so their office would have had it well before the close of business on Friday) I've been threatened with legal action, the "firm" is misrepresenting themselves as a law office and now I received a letter through the USPS from them claiming to be the collection agency in charge of recovering the debt. Thus far, there are three violations of the FDCPA.

 

can you be sued if you are below poverty?

Hi I have 4 loans defaulted at max ammount. $575 + $25 NSF fees on each, so a total of $2400. The loan companies are Allied Cash, Advance America, Ace Cash Express, and Ez Cash. They are all store front. I defaulted in July and now Allied is telling me if I don't pay them in 30 days they will send my case to their lawyer to have me sued for wage garnishment. I live in Colorado, where the max garnishment is 75% instead of 25%. The thing is, I'm the sole support of my family and we are already below poverty level.

I live in the state of texas and I was recently contacted by a business stating that if I didn't pay the loan I received from cas advance that myself and my references would be taken to jail. The amount was for $523.00. I made one payment of $250.00. Can they do this?
