Hi, if I go through this debt settlement process, will the creditors be able to take money from my IRA account (or any retirement accts)? I may need to cash them out anyways to pay for the settlement, but wanted to know if I should be concerned. My IRA is not with any of my creditors. Thanks

I live in Ohio. I'm filing my bankruptcy on 03/15/10. I received a letter in the mail from a pay day loan company for small claims court on 03/24/10. I spoke with my bankruptcy attorney about a hour ago and she said once i file there she can call the small claims court and let them know i have filed and i won't have to go to court. is that correct?

I need to get some current addresses for Together Cash and Fox Enterprises. I found addresses on this site and the BBB site, but my payments keep coming back saying the addresses forwarding order expired or the address is incorrect. For Fox Enterprises these addresses are not valid: 13929 Normandie Ave #224, Gardenia CA 92049 and 1004 Depot Hill Road, #2-D, Broomfield CO 80020 For Together Cash, this address is not valid: 4755 Pine Springs Drive, Reno, NV 89509 Any help would be appreciated.

Since i will have filed on 03/15/10, will they still be able to get money from me?

I have a civil suit default judgement on 02/09/2010 in Canadian County, Oklahoma from a credit card debt. I did not appear due to illness and taking pain medications (fear of disrespecting the court) nor did I file the discovery because I didn't know how. I have doctors notes and copies of prescriptions. How long do I have to file a motion to vacate or what are other options? The only information I received from the Court Clerk was that Oklahoma is a non form state. I can't afford an attorney much less the filing fee. Also, would there be a warrant for my arrest for not appearing?

Now, I am contacted by a collection agency who is supposedly trying to collect on an old cell phone account. I have pulled out my credit report to check if they are reporting it. Amazingly, the CA isn't featured in my report. My question is- can a collection agency collect on an account that is not appearing on your credit report?
