Hi. I'm looking for advice on my husbands defaulted student loan. In April 2009, my husband completed 9 months of loan rehab payments successfully for a US Dept. of Ed. loan to DCS collection agency. The agency sent papers for him to sign which he promptly sent back so that his loan could be placed back in good standing and lower payments established. About a month goes by and we hear back from the CA asking for paperwork. We state we sent in paperwork, and CA claims it was not received and possibly lost in the shuffle.

I am just starting out with this. I have 90k in cc debt. 6 cards. I have just contacted my creditors to open the door of communication. They each offered me a reduced rate of 6% for 12 months. My questions are: 1. Should I accept these offers, then default 120-150 days and then negotiate settlement? That way I am saving interest that is accrueing on the defaulted loans while I save up. 2. After 120-150 I expect to have some settlement offers. What if they all come in at the same time? I won't have enough saved by then to settle with them all. What then? 3.

I've been getting harrasing phone calls at work about a payday loan from E Pay Day loan. This was taken out about a year ago and I haven't heard much from anyone. I live in MS and it was my understandig that they were illegal here. I have offered to pay principal only but by MO. They refused, so I refused to pay any other way. This guy named Sam Anthony is calling from Alstead Financial. He gives my HR manager's name and says that they have verified employment and I'll be sued on Friday if I dont call back.

Has anyone ever dealt with them? They are in Georgia, I am in Oklahoma, can they file legal summons against me without sending me something in writing prior to that?

So Macholl and Johannes Law Firm has sent me a notice, as they initially informed me that they would, that they have set trial for April 21st to take me to court regarding a past credit card debt upwards now of $15,000 (original debt was $9,000). I have no choice but to be present without counsel because as you might have guessed....can't afford it. I have even attended a course at the US Bankruptcy courts here in Colorado to learn the basics of how to file bankruptcy pro se. My first question is what should I expect at the trial, especially without counsel?
