I had an AmEx account go to charge off about a little over a month ago. I had Zwicker and Associates send me a letter regarding this, and then I sent them a Debt Validation letter. All they sent me was a photocopy of a statement, so I sent in a second request for more information. In the middle of all this (after I send the DV Letter to Zwicker), I am not being contacted by a firm called Smith Debnam regarding this same account.

A friend of mine took out a payday loan, $1,000 and has to pay back $1,500. In Massachusetts Payday companies are only allowed to charge 23% interest and a max of $20 for a fee. Seeing as they are charging him way more than this, does he have to pay back just the principle or what MA law says, 23% interest plus $20 for the fee????

Gordon and Wong have had our account for almost 2 years. They made us a settlement offer but would not hear of us making payments. We made them a settlement offer in writing including payments which they ignored. When they got more threatening I sent them an unsolicited $500 check which they cashed. they then sent me a letter asking me to confirm the arrangement we agreed upon, but nothing was spelled out. I did not send them any more $$ as another financial emergency came up. It is now almost one year later. We just got a letter from them telling us they wanted to settle the matter.

I hope to settle with BOA and Chase in the next few weeks. Other than dollar amounts and due dates of when payments are due; what other things do you want to make sure is in writing to help your credit, etc.? I mean, will they agree to reporting it as "paid if full" when it isn't? Will the also agree to remove any negative reports with credit agencies for the previously missed payments?
