Hi Guys, My brother received a call today from the ACM group stating they were with a litigation group & want to garnish me with a summons.They left a phone number and file number.I know this is collections agency and have never received anything from them his collections activity.I believe they have bought some old debt of mine and are trying to collect.

 

What are my chances of getting a mortgage?

I am going to try and keep this short. I am a current homeowner. Due to various problems (unemployment, health, etc), my husband and I accumulated a lot of credit card debt and then got behind on our payments. We have now settled with many of them, and never were late on our mortgage or car. My credit score is currently 665, but with some recent settlements noted. Now the work situation is still a mess, but starting to improve a little. But the catch is I am now self-employed and we would really like to sell our home and relocate.

 

BOA/ Countrywide

Does anyone know if I would be able to take legal action against BOA/Countrywide for taking an unauthorized amount of $ out of my account. I did an electronic check over the phone and the girl processed the check for more $ than what I wrote the check for. I am trying to find out if I can any sort of legal action against them for doing this.

Providian is no longer listed on my credit report because Chase could not verify or validate it. So why does LVNV still list it?

 

Bank of America charge off question

My Bank of America accounts went past the 180 day mark with no settlement agreement. Does anyone have any information on what Bank of America in particular will do next. Do they have a legal department that will handle it for the next 30 days? Can I possibly still work something out with them now? Just want to know what to be prepared for.

 

Chapter 7 questions

I am in the process of filing for chapter 7 but I have a few questions. Now from what I understand with preferences if I paid a family member back on a loan a year prior to filing they can not be sued, is this correct? What my situation is, in Nov of 2008 I paid back $8000 to a family member on a loan. I only got this money because I was in a car accident and paid her off with it. Now I need to file chapter 7 but do not want her to get sued. From what I have read all around it seems like the best thing to do is file after the 1 year date from when the loan was paid off.

I have about 20k on a business card with Capital One. 2 mo. ago they doubled the interest rate...not due to late payments. They informed me that a (one) letter was sent out that notified of the rate increase and if you did not accept it they would freeze your current rate and cancel the card. I let them know I did not receive the letter and would like to cancel and keep my old interest rate...they refused. I have not paid it since. I read the post (most current I found was march on the debt settlement for this company and they seem to sue right away.

Anyone that can chime in, In June i receive a letter from Fred Hanna representing Arrow Financial assignee of Wamu. It's apperent Wamu sold the the debt to Arrow. I sent them a DV letter and they never respond to my request for proof that i owe the debt. Now i am being sued by them. I have not received the summons yet due to the sheriff department has not served me yet. I know i need to reply to the suit. What are the steps? Do they still can sue me even after i have sent them the DV letter?
