I was sued by an OC, and was sort of coerced by the court into a consent judgment, wherein I will pay a nominal amount every month and in 6 months they will do a debtor's examination. (I basically pleaded poverty, and truthfully so.) If things get better financially in 6 months, can I bring an attorney with me for the debtor's exam? I am trying to get on Social Security disabililty, which I know is exempt income, but the judge made it sound like when that kicks in I should be able to pay the creditor more.

If a lawyer sends a letter to you after the judgement asking for bank acct info, social security etc. do you send it to them or does it have to be court ordered.

I finally worked out a verbal agreement over the phone today with a collection agency to settle some old student loans that I neglected. They were very old and very neglected. The settlement offer was 100% principle, 50% interest and no fees/penalties. After they gave me their offer I told them I would call them in a day or two confirm that I could free up enough money to settle. If I couldn't come up with the lump sum I said I'd work out a payment plan when I called back. Are there any "gotchas" I need to look out for when working out a final written lump sum settlement?

Hello, I've been reading up on a lot of helpful info on this site and wanted to know if someone could assist me in getting rid of my payday loans. I currently have 4 of them and need them to stop debiting my account every month. I know I got myself into this mess and need to get myself out, but its so hard with other bills and such. Any help would be greatly appreciated, thanks!

Here's the situation. I have not got a bill from Best Buy credit card/HSBC since February 09. Automatic payment was set up in December 08, and then mysteriously HSBC changed my bank account number they had on file and charged me all kinds of fees for not being able to get payment. I spoke with a handful of managers who were less than helpful. Nothing got resolved. Months go by. I get nothing in the mail, don't hear from them at all. This week I start getting calls from various area codes.

We just recieved a court summons in the mail for an outstanding credit card debt. What is my first step in this whole thing? I have 28 days to respond, but who do I respond to and how. I do not have the money owed since a bogus debt settlement company ripped us off and put us three months behind in payments, then the interest rate went through the roof. Every creditor was willing to help us out except this one (Capitol One). My wife contacted them on the phone and he was willing to take a $3000 down payment and $240/month (on a $13900.00 debt now at 32% interest).

i am on payment plans with ace, cashland, national check cashers, always payday, advance america, thought i lost job 2 weeks ago, call and told them all that set up payment plan, my boss the next day said he was keeping me and cutting my pay.

Hi, can't get my logon to work and can't find my other thread. I was wondering has anyone with zip19.com, integrity advance, ameriloan or Pdl ventures been able to work out payment arrangements that were affordable. I tried talking to them since we were getting weird hang up calls from 800's numbers. But not one company accepts money orders or would work with me. Ameriloan was flexible with three payments but they were too much right now.
