HI.... I am somewhat confused about filing chapter 7 with judgements. I have a judgement for owing SSI overpayment and last yr the govt garnished my income tax refund and one credit card co. just filed a law suit against me about 2wks ago and iam guessing if i dont respond to this it will become a future judgement. I only work part-time and not able to pay. If i file for chapter 7 will it dismiss these judgements? Please advise. Thanks.

 

How to reach settlement agreement before court date.

I have received a summons by a Law firm for a CA. The amount is 6250.00. This is an account that I had worked on with Credit Solution. I now realize my mistake with that company. I started with CS 10 months ago and they said the account would never go to court, they just kept advising me to save as much money as I could. Meanwhile they never even attempted to reach an agreement for me. Now, I have received a summons and I want to try to settle with the Attorneys. The problem is that they don't want me to make a payment arrangment with them, they want the money in as little as two payments.

I am so frustrated with all of the credit card companies. Just need to vent a little! I am trying to settle my last credit card with Chase. It is currently 60 days past due.They are only offering an 80% settlement to date. I will wait for 35%. I have several other credit cards with lines of credit, but they are all paid off. I have two other Chase credits cards that has a zero balance with no late payments ever.

 

Settling debt with Mortgage Company

Have any of you ever heard of a Mortgge Company settling with a customer for the note on the house and the difference between what is owed and the appraised value? I owe $140k on my Town Home in AZ and comparables are being listed around $95k. I would like to have the place appraised and offer the deed to the house and the difference between what I owe and what it's value is ($45k). Anyone know if mortgage companies have settled in this fashion before?

Ok --Husband received summons from the court, being sued from HSBC. We received the summons on July 23rd and we had 30 days to answer. We are filling BK, within a couple of weeks. My question is once the 30 days lapses, does it still take some time before they can actually get a judgement? I'm hoping we file our BK before anything is sent to my husbands employer for a garnishment.

 

Help Needed - PDL Question

If I send out cease and desist letters to all the PDL companies, since they are not licensed to lend in the state of CT, won't the letters be meaningless? I am worried that they are going to harass me at my job and I don't want to risk losing it because they won't stop calling.

 

Can they really do this?

See below for fine print excerpt from my nationwide cash contract. I have opened a new account at a different bank and have yet to use it to pay for anything. Would they be able to go into the new account and debit legally since I agreed to this?(should have read the contract better). How would they get the info? "5.

this company is a major rip off.....they are charging people 29.95 per month plus 30 percent of thier outstanding debt before they give any money to people's creditors.....if you owe $1000 you would pay 329 in fees a month before they would even help you start paying off your bill.......shameful!!

 

Collection Calls from numerous #'s by same Co.

Okay, I am not even 30 days late for a credit card pymt. I understand collection calls and FDCPA as I worked for a collections dept before. My question goes to something I have never seen before. This credit card co. is calling numerous times a day but from different numbers with different area codes, trying to trip me up. This can't possibly be legal can it?

 

Can someone help me calculate wage garnishment?

So i may be garnished for around 10k. I make about 1400 every two weeks and take home after taxes, medical etc around 1050. If NJ is a 10 percent state gross or 25 percent disposable. How would that work out with the exempt amount i read about, a # times the minimum wage or anything like that. I'm a little confused on the topic, can someone help me?
