dischargeable?

I know there is a difference between private and federal loans. There are loans that go directly to the school which could be federal or private and are non-dischargeable but if filing for BK the private loans where the money got sent directly to you and could use the money on whatever you want, are these type of private loans dischargable? I would think they are because there are not strictly educational loans. any help?

Long story short - I made some bad mistakes when I was 18. I'm finally catching up financially. I have a credit card bill that is with a collections agency that's around $1200. It was originally $2000, but I've paid it down a little over time. I also got a car repo'd that was worth $9000. It was auctioned off and now I owe like $4000. I called the car lender and they're willing to settle for $2500. I can pay one thing completely off and make around $300-$400 payments to the other. My main thing is that I need a new (used) car.

 

Does the 7-year reporting law apply to original creditors?

I have an old account that has had a $148 balance since 2001. I know for sure that no payments have been made since then. I think the OC uses SOANB to service their accounts. The CB lists the account as charged off in July 2005 and is scheduled to continue on record til April 2012. 11 years since the date of first delinquency? Really?

After many weeks of ignoring their calls, they finally sent me something by mail. :The following information is being provided in repsonse to oyour recent communication concerning the account ref. above. This account and its proceeds were sold, assigned and transferred by the Seller to Portfolio Recovery Associates on 6/12/06. At the time of the sale the Seller provided an electronic file of its business records concerning this account.

 

Asset Retention Search

Does anyone know if an "asset retention search" is a real thing or not? Some blowhard from Mercantile left a message today that an asset retention search was scheduled for a property at our address, and to call them 'right away'. I've seen several references to people at Mercantile being full of sh*t. Thanks.

 

What to do if PDL company doesn't responded to emails?

What should I do if a PDL company doesn't respond to my emails? I closed my account, faxed and emailed my ACH revoke letters and I have one PDL that has not even responded. I proposed my repayment plan and requested their address in which to mail my payments and they haven't even acknowleged me. What should I do next?

 

Payday Yes-legal or not in Tennessee

Can anyone tell me if Payday Yes is legal in Tennessee? I know from the boards that Tennessee law dictates a lender only has to be licensed somewhere to lend in Tennessee, but I seem to find conflicting info. about Payday Yes and whether they are actually licensed. Also, has anyone had any luck negotiating with them? I had agreed to payments to settle the account, but the amount keeps changing (increasing). Then I received an email that said Good News!

Almost there! I only have one open unpaid collection of 900.00 leftand it is for an old auto lease from 2005! No new delinquent collection account since. Everything since is paid as agreed and good! These forums are awesome! Very helpful! I do have one quick question...I just checked my tu file. One of my paid collection accounts is reporting a date of deletion a year later than the original creditor..I thought everything about this account was to be deleted off cr at 7 years. I have disputed this through the credit bureau with no luck. Any insight would be helpful..Thanks..
