My husband got throat cancer about 12 years ago. About 6 years later he started feeling better and we bought him a vehicle. A few months after the purchase, his health went downhill and we contacted Bank of America and told them we could not afford the vehicle anymore. They told us to drop it off at a bank near us and then the following day they sent a truck to get the vehicle. After about a year, the bank started calling asking for the balance of the note. After a number of calls, they stopped contacting us. About a year ago, we attempted to file for bankruptcy.

writing a bad check when taking out a payday loan? I'm pretty sure the answer is no and that it's not the same thing as writing a bad check, say to a grocery store. I want to be absolutely sure though. I still have a couple of old PDL's that I owe that have now gone to collection agencies. For example, could the DA in the county I live in prosecute for NSF check writing if the check was written to get a PDL? Three PDL's I'm dealing with are all legal - Cash Net USA, Cash & Go/First Cash Financial, and Payday One. Istill have to pay back the principal on all of them.

I am attempting to settle/negotiate a debt with Firstsource Advantage LLC, but the number in the letter they sent me (1-866-276-8306) just keeps ringing w/out an answering machine, and the number I found online (716-564-4400) is apparently disconnected. Any idea what gives or what their real # is?

Does anybody know the website or office I need to go to so that I can find out if a collection agency is licensed to collect in my state?

This site says not to contact CA's by phone, but the sample letters only include counter-offers to payment plans made over the phone. Should I call to make an initial offer and then counter-offer by mail, or should I begin by mailing them an offer?

I owe 30,000.00 in credit card debt.  One is $15,000.00, the other is aprox. $18,000.00.  Iam trying to negotiate w/ the creditors' and have succeeded already w/ 3 other creditors.  I have rec. a notice for arbitration for a credit card debt of $18,000.00. I responded to the notice w/ a list of why I can't afford to pay the full amount.  I offered to settle at $1500.00.  What can I to prepare myself if they take me to court??  I know they want you to have legal representation, but I am willing to do this lump sum settlement.  Do you think they'll go for that??

I opened a cc account in Missouri and defaulted on it in June of 2004 while I lived there. I moved to Colorado in 2006 and am now being sued here in Colorado, the county that I live in now. (Still under the sol for either state.) My question has to do with jurisdiction and venue. According to the fdcpa, 15 USC 1692i Section 811, the debtor may only be sued in the county in which he resides at the commencement of the action or in the county in which contract signed the contract sued upon.
