Question:Hi, I went to civil court early this morning, only to have my case dismissed by the judge because the plaintiff failed to appear. Now, I read that this means that I won by default, but is this true for all states in the US? (I'm from New York) I would also like to know whether the plaintiff can make a motion if he has a valid reason for not showing up (ie: traffic, emergency, etc.). And if he/she does, what would happened to my dismissed case?

Ok, so I am not even sure if this is an option. I am in way over my head. A year behind on 4 credit cards totalling oaver 20k, DH and I are living paycheck to paycheck and the debt is my debt solely although incurred while married. The cards are only in my name, the house mortgage is in his, the cars in his. Can I file Bankrupcy and make this go away or will it affect everything and if so what are the ramifications of doing so? and what are my options?

Hi all I was hoping for some advise from you. I have been negotiating with Bank of America for lower payments and lower interest. They agreed to 0% interest and lower payments and then we agreed that the first payment would be taken out on Dec. 1st. On Nov. 20th I received a call from them saying they had made a mistake on the date and wouldn't be able to take it on that date and that it would have to be taken out on Nov. 26th. I told them no, the money wouldn't be available at that time. They said that I wouldn't be able to start the program then and we would have to wait until Dec.

A very brief summary: I live in Texas. I have 4 outstanding payday loans- CashAmerica (aka PayDay Advance), First Cash Advance, PayDay1, and ameriloan. I know I have paid Ameriloan much more than the original amount... but I would have to track down the exact figures. The first two listed are storefronts and the last two online. I know from past information gathered on Debt Consolidation Care that Ameriloan isnt legal... I dont think its legal period. Not just not legal in Texas. Well I talked to my bank- Chase- about possibly freezing my account.

In being sued by CC,if the date of last payment on the account was 12-19-2005 and a claim for suit filed 11-21-2008, was served papers on 12-02-2008, and the case won't even go to arbitration/court until Jan.01, 2009 or later, will the SOL apply to the Nov filing date or by court date itself?Will I be able to say this account is past SOL based on date we go to court cause by then it will be past 12-19-2007 so past the 3 year SOL or does the filing date count being that they still filed within the 3 years whether it was 3-4 weeks prior to expiring or not?

Has anyone had any luck settling with Bill me later? Do I need to wait for it to go to a 3rd party collections company before settling. They told me they would only remove the late fees... They do not settle accounts. Anyone have any luck?

I am in a settlement program right now, and it's been going great, four accounts settled in just the first year! However, I have an account which has been sold to a bottom-feeder collector that has served me a summons and unless we can settle soon, I may have to go to court. My settlement company has been trying to negotiate with them, but the collectors want 80% in a lump sum. I cannot do this, I have no resources to do so. My question is this: Can wages be garnished, if I have $500 a month going into a settlement program that this account can be settled with?

Hi, i ran across this and read ALOT of the replies, heres my problem, I too live in pa and have about 5 internet pdl's from other states. I just closed my account and re-opened a new one, thanks to some of the advice on here, and heres what i owe and to whom: cash net usa orig 400 paid 830 still owe 350 discountadvances orig 700 paid 1230 still owe 420 paydaymax orig 250 paid 375 still owe 220 paycheck today orig 300 paid 270 still owe 390 paydayone orig 700 paid 1490 still owe 900!!!!!!!! what is my next step? anyone help??

Like many of you i got into payday loan hell a few years ago. I tried closing my account/putting a freeze on it everything but since it was negiative, the branch manager wouldn't do anything. I've complained to NCUA (since it was a credit union) they refered me to my financial insutition which in turn said I'd have to go back to the payday lenders. Well one of them said that I signed a contract stating they can go in at any time and collect money. I asked our Financial department if that by signing a contract trumpts the law and they said they don't.

I have two PDL store front loans in MI. They have a repayment plan, but you have to pay off the loan in three payments. This is 225 per payment. Anyone have any sugestions on how to lower the payments?
