I never received a request to appear at a small claims hearing, I did however receive the judgment because I apparently defaulted by not going. I immediately contacted the court and went to pick up original filing against me. Now here is where it gets interesting, it was addressed to me in my Maiden name ( I was married in 1996) I showed up for the payment review schedule and filed a motion to vacate judgement since I never received original summons,also requested Debt val. Doc's form attorney on record that was over 30 days ago and I have court today to rule on my motion to vacate.

Okay I just pulled my husband's credit report w/experian and I am baffled by what I see. I see a CA Franklin Collection Svcs which states the original creditor is AT & T w/ balance of 578, Type of account states collection. Than I also see a CA NCO FIN/22 which states original creditor AT & T w/ credit limit 599 and it states balance as of 10/2008 707, Type of account states installment. So I have came to the conclusion that this is absolutly illegal how can two different CA try to collect on the same debt and when it is a collection it should say that not say installment.

Have a CL with BOA for 40k and have not missed any payments yet but wife has been out of work for a year do to illness and can no longer afford payments. Have already done a deed in lieu for our house about 6 months ago so this is the only debt left i will not be able to handle. Was thinking about filling chapter 7 since its unsecure but should I try a settlement with them. Do i need to miss some payments first? Also by bank account is with them can they freeze my money once i am behind?

Last evening my boyfriend recieved a phone call from a Investigator Stokes, saying asking if he was in on part of internet fraud and all that hoopla with me, they gave him a website to have me e-mail to tell them that none of my references we in on any wrong doings with me or they would be getting a subpeona. Now I dealt with another bunch of who haaas claiming all this crap, now when they asked what state they were in he would not answer, but I got the phone number and e-mail.

I have 3 payday loans. I have been regular with 2 of them but lost track of the other one. I need help. The lenders have not troubled me yet but I am sure they will do so very soon. I reside in South Dakota
