How many years after the discharge of a chapter 7 bk do you have to wait before you are able to file a chapter 13 bk?

If i were to send out a C&D letter today via email to webpayday what is the likelyhood they would not debit my account on the 30th of this month??...here is my history. (i have used them before and paid off loan+ lots of interest... made the mistake of taking out another) 06/05 took out loan of 800.00 06/30 paid 200.00 07/31 paid 400.00 08/29 paid 400.00 have payment of 400.00 scheduled for 9/30

I filed a complaint through the BBB.org in regards to the company handeling my MTE financial account. My account was supposedly sent to LRA (Lighthouse Recovery) who never contacted me. Then I get phone calls from a guy claiming to a be a lawywer from Lawal & Associates, who tells me they are affiliated with First Integral Recovery, LLC. To many freakin companies..anyway.

all my credit cards are paid up to date, but I am going to start negotiation with the creditors to reduce my debt. DO I still make payments?

So, LMP keeps calling me, I am pretty sure it is about a payday loan that I overpaid. I have not spoken with them on the telephone, so am not completely sure which overpaid payday loan it is. I do not have anything in writing from them, should I send them any sort or DV letter or Cease and desist letter? the phone calls are getting worse and now they are leaving me message at work about things they might be filing in my city. I know this is just a scare tactic. What should I do? Any suggestions?

i'm reading a few things on here about crazy ways CA's seek default judgements, in other words filling so that you may never find out you were even being sued. so what does anyone with experience or knowledge know about this? personally i have a dmp that i'm doing my collections with but i can't help but wonder if some shady way of suing me will come about
