Question on Garnishment creditor and Exemption in Hawaii ¼¼What is garnishment exemption on debtor™s vehicle in Hawaii? ¼¼Garnish creditor with a sheriff has a legal right to intrude into debtor™s home, search for his asset and attach it without debtor™s approval? ¼¼If debtor submit a proof to a Court in advance, that his car has no equity and so, it is exemption, garnish creditor can not refrain debtor™s car?

Does anybody have any information yet concerning the storefronts and their petition to go to the ballot in November? More importantly, should they NOT get the signatures (hope they don't), has anyone heard how they are going to work with all of us who cannot readvance? I heard rumor from one storefront that they will all offer payment plans. Any truth to that?? I keep searching for information online, but I can't find anything...

Why do people take out a loan they can't afford to pay back?? Doesn't it make more sense to not put yourself in such turmoil?

Pennsylvania has finally woke up and is changing the way it interpretes the law regarding internet payday loans! Starting February 1, 2009, all lenders must be licensed regardless of location, and must start following PA's laws on interest and such. This is great news for people in PA. The letter state's the PA Dept of Banking's position on this matter was changed due to so many of it's residents being taken by internet lenders. So see, those complaints can and do make a difference!

I need some help! I have a few companies calling and collecting on pdl's one is Legal Mediation Practice. I am going through hard times and they have been harassing me by telling me that I should expect someone to be coming for me at my job or my home ( as in the sheriff's). I have explained my situation that I have been recently left with 3 children (16, 14, 11) and am trying to get on my feet again. I told them I would need to make arrangments, but they are still telling me the same thing.

I am being sued by Asset Acceptance for a very old Chase credit card debt. It's been at least 10 years since I defaulted on this card, and it's well past the SOL cut off. The only problem is I don't have any proof of the date of last activity, and I believe the burden of proof is on me to show it is time barred. If I claim SOL as a defense, would AA need to show there was some activity on this account within the SOL? The only "proof" they have provided that this debt is mine is some in house "affidavit" that I owe the debt. No paperwork, contract, account history.

Thats all I need to come up for the lawyers fee and file. I will have it by next week. I did not realize it would cost so much to file Chp 7 $2500, I am in N. CA. The scary part will be the court appearances, YIKES! The pre-counseling session went over ALL that I owed and I owe more than 2x what we make in 1 year. I feel SOOOO irresponsible and more. I have learned a VERY expensive lesson, CASH IS KING from now on!

I live in MA. In the summons,it said I have to answer within 21 days. What do I do? How do I answer? The summons was left at my doorstep. Can I ask to dismiss the case since I was not properly served? Any advise? Thank you.

My case was dismissed with prejudice, If the debt is sold to another debt collector, can they sue me ?
