Why doesn't a 3rd party debt collector just sue right away when they get an account? Why waste 8 months trying to call someone?

Here is the problem. In September of 2007 I received a letter from a CA (Zakheim & Associates, in FL, stating that I owed them about 1,700 dollars, and that I had 30 days to request validation of this debt. I just put it to the side, not knowing what to do about it.In early December I received a summons to appear in court for the debt from the CA at the end of January. I came acrossthis site and I sent the CA a debt validation letter and I haven't received a response.

I have a negative item on my Experian report that looks to have been re-aged by a year or so. Seven years from date of first delinguency would have been four months ago, so it should be gone, right? I've never made a payment on it, ever. Heck, I didn't even know it was on there until last month. I disputed it with them in December, and it came back as 'verified and updated'. I just disputed it again, for all the good that's likely to do. At this point, I've just about had it. I've spent most of the afternoon trying to contact Experian and talk to an actual person, to no avail.

why would a collection agency not put it was assignee on a summons and matter of fact try to not have their name in the matter.the company is trak america and it seems they never list themselves as assignee of a debt???
