Using SOL helps!

19 years 9 months ago
I got a call yesterday from a collection agency called Allied Acceptance. I spoke to a gentleman (Keith) This was for an old hospital bill supposedly paid by workers comp. When I asked about that he said that he could do an investigation. Then I asked for the day of the supposed bill and it was over 5 years old. Ha- so I pulled the old "isn't this over the statutes of limitations time limit"? Guess what happened next.......oh come on guess???? THE BILL IS NO LONGER VALID, GONE! YEAH SOL.

Does this also apply to online payday lenders?

19 years 9 months ago
Can anyone tell me if this also applies to the online payday loans? If so, I have a few lenders that are in violation. TENNESSEE Tenn. Code Ann. § 45-17-101 et seq. Tenn. Comp. R. & Regs. § 0180-28-.01 (relating to federal disclosures) Applicability: To a person who holds a check for a period of time prior to presentment for deposit. Otherwise, industrial loan and thrift companies act applies. Tenn. Code Ann. § 45-5-401 (18% on loans up to $100; 24% on loans of $100 or more ). Licensing requirements: Department of Financial Institutions enforces.

Read this advice: Collectors at end of month...M.O.!

19 years 9 months ago
Hey guys, Keep in mind that end of month is crunch time for debt collectors. They have quotas to meet, and this is the time that they will pull out all the stops to get their money. They want their bonus! They will say things like, "You have until 5PM to call me back." (Technically, if you really wanted to press the issue, they really are not supposed to deadline you unless they have a clear course of action planned...and they intend to do it. Otherwise, it's a veiled threat.

Cash Today

19 years 9 months ago
I received a call this morning from a Matthew in the Legal Department at Cash Today telling me that I am being recommended for legal action against me and if I call him today by 4pm, then he can offer me a discounted settlement. I have sent these guys 4 validation letters and they have yet to respond to me. He then said on the message that he will be getting my company involved and they will be named in the legal action for garnishment of my wages. First of all, I live in Texas and they can't garnish my wages. To get on the phone with this guy and argue with him is pointless.

need to know how to dispute after judgement

19 years 9 months ago
We are attempting to dispute a debt from 1997 that we have no infornmation about. A law firm received a judgement against my husband in January of 2000. And is trying to collect payment. We were never notified about the court date or given any opportunity to dispute. The law firm now claims the only validation they need to collect is said judgement. Is there any possibility of disputing this judgement?

how to respond to call

19 years 9 months ago
hi... i've received a couple of msgs from a "law office", only that "i" should return the call. i did, then hung up when i heard it was about "an attempt to collect a debt", not sure how to respond, since i'd read a few posts on this site... so how do i respond when i call them back? do i offer my name up front? if the debt is legitimate, do i admit i owe it? or is this a case when you would ask for debt validation, by way of letter? advice would be helpful.
