can you still help, if I stopped paying chapter 13 and know I'm getting all the colectors trying to collec full payments from my debt. I need a way out and I don't know what to do . Help! what can I do ?

Exactly how does this work??? Do you consolidate all the payments into one monthly payment or what?? and does this look bad on your credit?

If Sonic Payday was to do a wage assignment on my wages, do they just take a percentage of my pay until the loan is paid in full? If so, what is the percentage they take? Thanks Kathy

I was able to get some quick attorney advice on the cheap from one who has a lot of background in fdcpa, and learned something very interesting. According to him, based on the above, as soon as your OC begins to collect on the debt themselves, they are covered under all provisions of the FDCPA.

 

Mini Miranda Warning - Is anybody aware of this

Vikas had posted the above in another thread, and so that I'm not hijacking from that thread I wanted to start a fresh one to ask a specific question. About the above -- I read on a site run by an attorney that in 1996 an amendment was made to fdcpa which requires the "mini-Miranda warning" to be included only in the initial communication. Subsequent communications must only cite that the communication is from a debt collector. Has anyone else seen anything similar to the above?
