A debt collector can switch dates of the accounts as they put it in the credit agreement. But as per the fdcpa law, a debt collector is restricted from reporting false information on your credit report. The dates get changed when an account is changed from one lender to another. If you find the date appearing in your credit report to be written wrongly, it is necessary to dispute it.

debt collectors are required to follow the rules laid down in the Fair Debt Collection Practices Act. If you find any such debt collector violating the law, you can take the following action:
  • You should keep a detailed record of the communication held between you and the debt collector. You should include date, time, and the name of the person who has called you.
  • It is necessary to keep a copy of all the written correspondence between you and the debt collector. Report the company in writing.

I am at a point where I am keeping pace slowly, but not getting ahead. I have basically exhausted my passbook savings and the money in the kids savings (stupid move!) and have bills on the horizon that aren't any closer to being paid off. I haven't paid my real estate tax bill yet either. I have a friend - lets call him John,since thats his real name - ha ha - who did the bankruptcy thing last year, erasing his huge credit card debt. A breath of fresh air for him, and he still was able to purchase a new home with his new wife a number of months ago.

I was making a decent effort to pay off my credit cards on a methodical basis. I paid off the card with the highest rate first, like I'm supposed to do as per most of the advice I see, and then I thought I would be smart to close the account and move on to the next card. The card with the biggest balance (but lowest rate) decided that my debt ratio was too high now, so they raised my rate with them to something like 18%.
