Help AMEX/Zwicker Settlement

I am over 120 day late with an AMEX account (35000) that has been sent to Zwicker and Associates. I borrowed some money from my inlaws to try and settle. When I talked to Zwicker they said I was not eligible for settlement because litigation had begun. They said that the litigation is on hold because they offered the 0% for six months plan but that if no payment was made the litigation would continue. Has anyone been in this situation or does anyone have any advise. I can only borrow enough from my inlaws to pay about 50%. Thanks!

You may check with the county court whether there is any case pending against you. A summon would be served to you if you have got sued. Receiving a summon can only confirm their claim.
