Yes, a 2nd mortgage can be stripped in bk. Did you file a Chapter 7 bankruptcy? Was it included in your schedules?

Yes, my Chapter 7 was discharged in July. We didn't reaffirm the mortgages, but I have been paying the 1st inorder to try and keep the house. Would we have had to do something special to have the 2nd included in the discharge or would that just have been done automatically? If so, can they do anything to try to recoop the money? We would like to stay in the house for a couple more years and then try to sell. It will mostly likely have to be a short sale since I'm sure we can't get enough money to cover the 1st and 2nd mortgages.

I just spoke to our attorney and the 2nd was discharged, but they still hold a lien on the house so they could still try to foreclose.
