Sued by discover

13 years 11 months ago
Hello! I was served a summons from Discover card yesterday. I wasn't sure what to do with it! It's for $10,163.68 + $800 lawyer fee. I stopped paying on the account 3 or four years ago. I was planning to settle when I got a decent job but that didn't happen. I think I'm pretty much judgement proof though. My tax return says I earned $5000 last year, and am currently unemployed and live with my girlfriend. I own a car worth about $5000. I haven't had a job for most of this year, I've been training to become a massage therapist.

Response to ACH revoke letter - Cashjar

I have PDL with Cashjar for $300, I have paid $265 of "renewal fees" and sent ACH revoke letter and received the following response, and not sure how to respond back: I am writing on behalf of Cash Jar in response to your recent email. Cash Jar strives to assist consumers with their short term cash needs and is concerned that you were disappointed with your most recent experience.

Collection Agency faxed dunning letter without permission

13 years 11 months ago
Hello. Quick background on what happened. Collection agency ( Liberty Processing) called two days ago. I answered the phone and asked for a dunning letter to be mailed to my home address. Man on the phone said he could email or FAX the letter and then started asking for payment or the acct would be forwarded to litigation. I repeated to send me the dunning letter and ended the call. The debt is for a 400 dollar payday loan that was made 4 years ago.

This is a tricky question. If the debt was incurred back in 2004-05 and you haven't received any collection effort on it, odds are the debt was written off and not pursued. In that situation, it still would show on your credit as a delinquent account/debt and be a hit moving forward. However, if you settled the debt, completed the tax form and it's no longer on your credit report - then I think you can treat the debt as resolved and move on. The rule with debt is once it gets resolved on your credit, usually you are OK.

Discover close to charge off - what happens then?

13 years 11 months ago
I'm running out of time to settle with Discover. They aren't budging. I have a settlement offer of about 70% on the website, but I don't have that much money. When I call in they tell me my account is not eligible to settle. What happens when it charges off? Do you think I might have better luck settling then? Or should I just call in every day and try to get them to settle before charge off? Any good tactics to share?
