Hello, So sorry to see that you're dealing with this. If this is indeed a bill collector (and, based on his rude tone, I'm led to believe that he is), they definitely broke the law by not complying with the Fair Debt Collection Practices Act (FDCPA). Bill collectors are prohibited from threatening you with a lawsuit unless there is actually the intention to file suit. And, I'm sorry, but only law firms can file suit, so this man is simply trying to scare you.

 

Finance Companies

I have a question about finance companies. I live in Georgia and have three loans with three different finance companies. I had some hard times hit and have not had any money to pay my monthly payments for the past two months. I have tried to tell them not to contact me on my job as my employer is very strict about personal calls. Well last week he picked up the phone when one of them called and then even after he let them have it, they showed up here at the office. If I send them all cease and desist letters, how will that work.

 

AWG and Consolidation

Is there no way to consolidate a loan that is in AWG? I received an AWG notice to my employer 2 days ago and have recently filed to consolidate the loan that is in AWG. The money hasnt begun being garnished yet, if I call them and tell them its going to be consolidated will they accept that?

Are they legal in GA. I live in GA and considering a loan after being solicited by them. I know pay day loans are not legal in GA. The customer service rep says they are legal. Can you help?

Hi, all. With the help of the Debt Consolidation Care forums, I broke the payday loan cycle nightmare in March 2009. I was living in a state then that didn't have a lot of rules regarding these loans, especially not the online ones. My husband is chronically ill and work has been sporadic and I was stupid and desperate. I used all of the tools here to close my bank account and send certified letters and reported everything to the proper authorities.

 

Verifying Payday Lenders Licenses for Washington

I was trying to verify pay day lenders license's via our states gov website: http://www.dfi.wa.gov/ and the parameters I entered did not bring anything up for any of the pay day loan lenders. I am now perplexed on where to go to verify if they have licenses in the state of Washington. Any help on the following Pay Day Loan Lenders (all were on the internet) would be greatly appreciated:
  • Gentle Breeze
  • Zip19
  • Plain Green Loans
  • DJAT Marketing/Lazer Lending
  • Idealgelt

Repo/Collection Question

I went through a rough time back in 2004. I had a car loan that I could not pay on. The car was repo'd in 2005. I am now being sued by Midland credit for the balance. What is the SOL on this? Does the SOL start at the time payments were not being made and loan in default or from the time the repo occurred? I live in Colorado. Thanks in advance for any help

 

Interest Rates charged

My daughter, who lives in California, got $300. from a Pay Day Loan place, and they charged $30. interest for EACH $100. Therefore, the interest was $90. for two weeks on a $300. loan. She had to make arrangements to pay it back a little each pay period because when it came time to pay it, she just didn't have it. Therefore, they are charging her $90. interest every two weeks plus $50. which they will apply to her $300. loan. As the loan is paid down, the interest will continue to be charged every two weeks at a rate of $30. per $100. If I have figured right, that is a total of $450.

This guy called my phone today, left me a message telling me his is Brad Sanders, (real mean) then he called my daughters house, left a very threatening message. I have NO idea how this man got my daughters phobe number, her name is even different. She is very upset with me, she doesn't like phone calls to her house from any debt collector.
