Usually the pdl laws will be applicable on the state in which the loan has originated. You should check whether or not pdl is legal in that state in which it has originated. If it is legal, then you need to make sure whether or not payday loan companies from where you have taken the loan are licensed to operate in that state. If it is licensed, then you will have to pay both the principal and interests. Otherwise, you are required to pay only the principal amount. If you default on the loan, then the lenders may file a lawsuit against you.

Western Sky/CashCall

14 years 6 months ago
I've seen people writing about getting a loan from Western Sky that is illegal and then having it transferred to CashCall. Has anyone had any success in dealing with CashCall, getting a PIF or any type of resolution from them? I live in PA. I took out a loan with Western Sky. It was immediately transferred to CashCall, but originated with Western Sky, which is illegal in my state. I am almost done paying the principal and would like to send them the C&D letters, etc, but I'm not sure if that will still work.

Ch 13 vs Debt consolidation ...and other ?s

14 years 6 months ago
My husband and I are so confused about all of the options. We have about $75000 in debt partially due to a recent foreclosure. Our incomes are better than average and so we will be required to pay almost 100% back in a ch 13. I'm not sure if debt consolidation is an option since I have been sued for 3 credit cards already. We are debating the debt con. route and borrowing from our retirement to pay it off but hate to do that and don't have enough to pay all $75000.

I have cosigned for my grandson for a private sallie mae loan.he graduated a year ago and has no job in his field. His loans are in deferment but sallie mae is contacting me. If this loan goes into default what can they do to me. Garnish wages, put a lien against my home, take money from my shared bank account? My husband and I are retired and living on social security. Can they take our income tax return? If I remove my name from everything and they sue can they still collect from my husband? We live in Michigan.
