I need your help. To make a long story short. I've been in South Korea for almost a year and I have a credit card with Chase that's about a year overdue. I found out that later that it was sold to Equable Ascent Financial (EAF). I then e-mailed (EAF) but I was later told that Gurstel Chargo (GC) is currently managing the account on EAF's behalf. Here is the problem. I e-mailed them several times to do a debt settlement. I've even sent several letters stating that I wanted to do a debt settlement. However, I've never received an reply to any of my e-mails or to any of my letters.

A credit card company is suing me and hired a private courier to put the summons at my door. Is that legal since I did not sign for it?

Hi I won a small claims case and the defendent refused to pay the judgement. I filed a garnishment against their bank account. I received a call from the defendents lawyer that they now have a check for us in the full amount of the judgement. It is a cashiers check. The lawyer threatened me saying that if I cash the check, I am liable for any damages the company may incur due to the garishment against their account until the court processes the "release of garnishment" paper work. Is this correct? Should I hold the cashier's check until the release of garnishment is confirmed.

Palisades has broken every law pertaining to collections. It is a numbers game to them. They try to get every fool in America to pay them something whether it is owed debt or not. The older the debt, the more of the take they get. Say you owed $3000.00 on a car GM repo-ed cause you lost your job 9 years ago. Palisades will get 95% of whatever they get from you. If they say you can pay $1500. and you agree, then they get to keep $1425.00. GM has already written the debt off of their books as a loss against their taxes.

I've been summoned to court saying they represent Capital One. I have an amount of $1,600 due (to them they say but then they tell me I can do a 36 month at $60/mo. payment plan ($2160.00)). I call Capital One a second ago and they refer me to some legal lady or whatever she was. She looks up my account and has no information on anything since Sept. 25 2008. They say that it it was charged off for $1007.32 on Sept. 25th 2008.

Hi everyone, Most of these posts are pretty old so I wanted to post a comment. I have been working with Zwicker for several months now to pay off a bad debt. They were not very nice at first but I have been working with a woman named Heather. She has been very understanding and helpful and does not talk down to me or issue idle threats. Each month, I get a reminder that my payment is due and then I get a statement telling me that they intend to withdrawal as previously agreed. They have only taken the authorized payments.
