Chexsystems - when will they go?

I have a few accounts in Chex that are all coming up on the 5 year mark in 2011. I have a few questions 1) Do these lines automatically get removed after 5 years? If not, what can I do? 2) If there is still a balance, will it be removed? 3) If I am paying off a balance, does it reset set that 5 year clock. IE if I had $300 dollar overdraft with Bank of America and paid it off or worked out a plan, does this mean the 5 year clock is reset Please advise, I really want to get out of this and have been in Purgatory for a long time.

 

Negotiating / Settlement Timeframe??

I will be 5 months delinquent later this month (Feb '11) on 6 credit cards totaling roughly $44,000. My master plan of saving for negotiating for settlements has not gone well. I am nowhere close to where I need to be. My question (for those with a crystal ball), how long can I drag this out allowing me more time to save? What should I expect? When I do have enough, should I pick one of the smaller ones and begin talks?

Received a call from Brittany Johnson stating she was going to serve me legal documents concerning a bounced check. first off I have never had a bounce check and I dont even use checks i only use my debit card. This is the first phone call and when I call them back all i get is a voicemail. phone numbers that was on caller id was 866-283-6604 however after doing research they use other numbers such as 877-412-6366 or 866-283-6603. I have attempted to call them over and over again however each time I call i get their voicemail.

 

check refused?

I wrote a check about 2 months ago and was refused at WalMart. I did not have any returned checks, but I was told it was a fairly new checking account. I had moved back to Arkansas back in September and my old bank did not have a branch locally. So I changed banks after 15 years. I am concerned that my check will be refused again if I write another one? It was EXTREMELY embarrassing and I left the store in tears.

Chapter 13 Candidate, Car Statements to Different Address

Good Afternoon!! I am currently considering Chapter 13 Bankruptcy. I have moved out of state within the last 7 months and my car statements have been going to a different address than where I currently reside. I have namely done this to prevent them from Reposessing the car, as I am 90 going on 120 days delinquent. I have been making monthly payments every month, just unable to pay the full amount.

How to protect money from 401k after cashing it?

Hello I am at a point where I absolutely have to take the small amount of money I have in my 401k. Its a last resort. My question is, if I withdraw the money, and my 401k company deposits the money into my bank account, should I be worried that creditors will find out I have that money and sue me or levy my bank account? Can they just take it immediately? (I have about 7 credit cards that have been charged off more than a year ago, the highest amount is about 2 thousand, the rest are $800 or less).

 

Should I file motion to dismiss?

Thank you in advance for any help, I am not sure what do, and am very worried. I live in the state of Montana and was served a summons on 1/27/11 by a sheriff. The summons was filed in justice court in a County I have never lived nor done business in, however, the creditor's home office is in the County that the summons was filed in. (If that matters). The sheriff also inadvertantly wrote July 27, 2011 instead of January 27, 2011. The plaintiff is a debt collector. The ammount is $536.99 with $263.50 tacked on for collection of debt.
