Okay, today in the US Postal, I received a collection letter from the above mentioned. They indicated in the letter that I owe Credit One so much money and "at this time, no attorney with this firm has personally reviewed the particular circumstances of your account". An hour later, I am served a summons from the sheriff of an "Praecipe to reinstate complaint - civil action" against me. How can they send me a collection letter and a summons on the same day.

Nelly: I am a unemployed person who has been harassed by MIdland for over a year . They filed a judgment against me in Cook County Court and I only found this out when I received a card from the court saying it was entered in July of 2010, although I was never served a summons by them . I am very afraid that they will now try and levy my bank account . I have since reloated to my home town be in search of a job and the calls have now started , even though I did not file a formal change of address or phone number with the US Post office. I currently have 3 internet payday loans that I have been paying on since June but cannot make the payments on Nov.1. What are the repercussions if I stop the Nov. 1 payments and revoke the ACH on the accounts?? I am in Indiana and the loans are thru Ameriloan, Instant Cash and OneClickCash. My name is on a friends account due to her driving a truck and being gone alot. I have not worked since Feb. of this year. She has let me live woth her and take care of her home and animals. I pay her bills out of the account. I just found that an old credit card debt is filing a judgement against me. Can they garnish this checking account? Even if I have not made a deposit in months?

I called a law firm after being served papers to request a settlement amount. I agreed to pay 189 a month by the 20th of every month. I received a copy of the judgment in the mail for me to sign and send back to the law firm. I did so within a few days of receiving the paper. It states that the judgment is being fulfilled as long as I make payments by the 20th of 189. All is fine, I send in my first payment. Two weeks later I receive mail from the law firm requesting I fill out a "financial affidavit".

Do you have to deal with a debt collector by phone? Can you opt to use mail or email? Just curious because I keep reading that its best to not talk on the phone with them since they can get your emotions all up and its safer to settle in writting. Any suggestions?
