I took student loans while in college. While in college I was convicted on a non drug felony charge. I was still able to take loans. I went to schoold for education. However upon graduating i was unable to get a job in education because of the felony record. I struggle for years to find gainful employment...years later, after finally getting a job and attempting to make good on student loan debt and other debts, I was unable to make payments and eventually had my check garnished. I am not disputing the fact that I owe money nor am I disputing the garnishment itself.

Hi, I recently returned a summons and was ordered a court date for October 15. The debt is for $4800 and is through Weltman Weinberg and Reis (Discover). I called them to propose a $100 a month settlement and asked them to mail me the forms agreeing to this premise. I received the papers today but the wording includes the words "Order of Consent Judgement" along with the agreed notion of $100 a month until paid in full. Will this wording now make it legal for it to show up as a judgement on my credit report? Is there anything I can do at this point to minimize more credit damage?

My mom has been on the payday loan rollercoaster for a long while now. She currently has payday loans out with four places. She is drowning in financial worry because her paycheck is commited to the payday loans when she gets paid and now her bills are slipping further and further behind. My husband and I lost over 50% of our income about 3 years ago. We have been trying to modify our home loan for over 18mths. After numerous attempts to communicate with our mortgage company and 4 trial programs, we finally decided that our only option was to file Chapter 7 bankruptcy, as our other, unsecured debt had also piled up beyond our ability to pay. Our BK attorney told us that our only option was to include our home in the Bankruptcy as we are behind on our mortgage payments.
