i have multiple payday loans out that i havent paid for multiple months because of finacial problems. can they take me to court? and if so i would go to jail would i? the guy said i was being charged with stealing the money. can that happen? i live in california. im scared. i didnt mean for this to happen.

I've received word that I won't be getting laid off this year, so I've decided it's time to start saving and try to settle my credit card debts. I'm 100% current right now, but my minimum payments + my car payment + rent is basically eating up most of my income. a. Sears Citi Mastercard: 23.75% APR; $9000 balance; currently on 9.9% hardship until mid 2011 b. Shell Citi: 9.24% APR; $6500 balance, on 0% hardship until August 2010 c. BofA: 6% APR, payment plan, $5900 balance d. BofA UPromise: 9.32%APR; $5000 balance e. Barclay's: 29.99%APR; $1000 balance f.

 

120 Days with BofA

I just passed my 120-day mark with Bank of America. Today I received a call from them with an offer for the first time. They're offering to settle at 35%. I told them there was no way I could come near that (the C.C. debt is $46,000). I'm assuming this will come down, but who knows? At first he said that's the lowest they could go--when I asked about negotiating, he said that was the best it is.

1. Go to your state's payday regulatory website and check and see if they're licensed in your state. If they're not then you only owe the principal. 2. Not paying your debts is not fraud by any definition. Anyone who tells you it is or tells you can be arrest is lying to you in order to scare you. 3. Unless you receive a summons from a licensed process server you are not being sued. However, if the creditor/collection agency gets a hold of your records and finds that you purposefully stopped paying, you may, and I stress may, have to pay the creditors court costs and attorney's fees.

 

Paying off the last credit card

I have one credit card left to pay off and cannot seem to get there. We have emptied out our savings to pay off so much debt for over a year now. And now that we are so close with one card left, things keep popping up where we have to use it for emergencies. Any ideas as to how to break this cycle and get this last credit card paid off? Help please!

i have been with fdrs for 2 yrs .things were going fine,they even helped me win against citi bank in court. my credit score had gone higher than when i started.and the creditors had stopped calling.now someone has purchased some old debt and i need them.my faxes are not going thru always busy.phone disconnected.does anyone know how to contact them?

I have reached settlements with all of my credit cards and they have been paid. I now am working on the tax situation brought on by the 1099-c's that I will be getting. I have a question about insolvency. 1. I am married and the debt settled was all mine. Do I put assets and liabilities for just myself, or since we have joint savings and own a home together, is her assets liabilities included in the total? 2. Is the date of agreement the date I should use to show asset/liabilities or is it the date that the money was taken out of my account?

Collecting on Judgement in Texas

My SO had a judgment issued against him in November of 2009. Today(6/10/2010) we get a letter from the bank wanting money or to set up a payment arangment or they will pursue other legal means to collect on judgement. I am claimed on his income tax as "spouse". My question(s) are: Can the bank "empty" my checking account? His name is no where near it. He cashes his paycheck and deposits money into it. Can the bank attach a lien or go after my house..Mortg.
