There seems to be lots on conflicting and confusing info with respect to sending out a DV letter. I am just over 60 days past due on my cc debt. I have received at least 2 calls daily and a few threat notices, but I don't recall seeing the "dunning notice" everyone talks about or anything that appeared to be a notice validating the debt stating I have 30 days to dispute the debt. That doesn't mean it wasn't sent, of course.

I have been told on several occassions that I owe Midland almost a 1,000 for an account I never had at a bank in California. I never lived in California at anytime,but they are saying this account was opened in California and I have to pay it. I never new of this account intill last year and have been fighting with them since. How do I go about getting this taken off my credit? I have proof of where I lived at the time and that I have never lived in California.

How many of you have actually been sued by Advanta or its collection agency? If so, what was the outcome? I heard they sue only in their home state of Utah. That means they would have to domesticate the judgment in the state in which you reside. I'm curious if they have gone to that extent. Has anyone been subjected to a debtor's exam also?
