We got a loan from SGQ at X-mas, but due to Identiity Theft, we had to change BANKS. I told them I would let them know when we were settled at our new BANK, with cards and checks and got a new account and would continue paying them. Well, couldn't get up with them. What they did was keep going into the OLD ACCOUNT every two weeks and tried to get their $90.00 payment, plus each and everytime, we were charged $39.00. My God, that got so expensive, we could not pay them. I told our OLD BANK that, too. I put in two STOP PAYMENTS, to try and STOP these people.

Hey everyone! I filed for Chapter 7 back in 08 and I still had two banks reporting me as delinquent, Capital One and a local Credit union. Well, two weeks ago I sent complaints to the Oklahoma Attorney General's Office. Last week I get an email notification from Experian letting me know that...The credit union account has been REMOVED from all three credit reports.

Negotiating During a Lawsuit

I am being sued by Capital One. I did not respond for the request for interrogatories they gave me in Oct 09. It is now March 2010. What are the odds the attorneys (Love Beal and Nixon) will negotiate during this lawsuit without filing a motion to compel? I almost think sending an offer to settle without admission of guilt and withdrawal of the lawsuit will just motivate them to ask for a judgement -- regardless of how cleverly worded the settlement offer letter is. Do attorneys ever negotiate at this point? What should I expect to happen? I am in Oklahoma and owe approx.

Does anyone have any knowledge on how the credit card companies determine who is offered a settlement and who isn't? From reading this forum that people are offered very different amounts and/or some are not offered a settlement at all and are instead sued. It would be interesting to see the situations of the people getting 25% as opposed to those getting 50%. Please share everyone.

I was sued by first resolution for a debt that was past sol....in 2007 the sent me a statement saying that bought the debt from another debt company not the original debtor providian I am taking them back to court do I have a change to win...has anyone else had trouble with this company

I too got a call from this company on 03/19/10 threatening legal action and to take the matter to court in the county I live in. I tried calling back the number to see if it would say the company name on their voice mail as when I called it was around 11:30PM ET and all I got was a voice mail and the recording was a woman's voice and after it went through the greeting, it said the mailbox was full and that an error had occurred. It almost sounds like this company is stealing victims identity. Check your credit reports to see if an affidavit has been entered against you.
