when is Statue of Limitations valid....???

my question is: if i have a court date in April to set a trial date....... and the trial date is set for June. and the Statue of limitations expires in May. Can I still use the Statue of Limitations to have the case dismissed? Is the SOL defense no longer valid when a suit is filed...... or is it valid since the actual trial is after the SOL has expired? thank you.

Ok, so I had already defaulted with this company after offering the principal amount plus the max amount of interest allowed in Alabama (where I live). They basically laughed at me and I closed my acct and opened a new one. I now know (but cannot prove as of yet) that they used my SS # and pretended to be me to get my new account info, and they began to debit this as well. It is no longer about the money with these guys, I will not rest until they stop doing this to me, which will not happen until they face their crimes (wire fraud, identity theft, etc).

Hi Folks, Great website. I read thru the thread with the similar subject line but the answers were all in the context of post 2005 rule changes. Here's my story.... can anyone help figure out who still has an interest in the property? Colonel Mustard - with the candlestick - in PENNSYLVANIA (ha ha). The property is a poorly maintained house of lowlevel drug dealing.

 

Starting out and need help

I am just starting out with this. I have 90k in cc debt. 6 cards. I have just contacted my creditors to open the door of communication. They each offered me a reduced rate of 6% for 12 months. My questions are: 1. Should I accept these offers, then default 120-150 days and then negotiate settlement? That way I am saving interest that is accrueing on the defaulted loans while I save up. 2. After 120-150 I expect to have some settlement offers. What if they all come in at the same time? I won't have enough saved by then to settle with them all. What then? 3.

 

Settling a private student loan (Dear SoapLady)

Hey there, long time lurker, first time poster. If it weren't for this forum I don't think I would have ever found the motivation and information to finally get my debts worked out. Anyway, here is my situation... I have 3 student loans total, 2 federal loans (1 unsub stafford, 1 sub stafford), which I have applied for consolidation through Direct Loans. If that goes through, I will be able to manage that. The third loan is a private student loan, that I honestly had no idea about until a week ago. The original loan was in the amount of $4,800, and it defaulted in 2003.

When should I start negotiating?

I have about $40k (principal, interest & fees) in cc debt & my FI has about 13k. I am getting money soon from a real estate transaction and will be in a position to settle our debt. Should I start the negotiation process now, or wait til I have the cash in hand (2-3 weeks)? My accounts are with B of A, Chase and Capital One.
