I had a judgment filed against me in 2007 when LVNV Funding Sued me. Yes I owe the money but I cannot pay, they cannot take my income because I am income exempt. I am on Social Security Disability and I also have no assets they can take. I have not heard a thing about this until today. I got a call from Central Credit Services, Inc and at first I didn't know what they where calling for until he told me about the judgment. He asked me how much I was going to pay and gave me a lesser amount than what the judgment was for. I told him I am on disability and can't pay.

Hey, quick question - i have been getting calls at work from Marval and Associates. I know it is payday loan related but who are they?? i have not taken a loan out since March 2008!! And they really are settled up (I over-paid on almost all by a lot, a lot of money.. the rest were taken care of). I got a call today, I was in the middle of speaking with a supervisor and I recognized her voice (her name is Kathryn). She asked for me and I screened my calls, said I was on vacation. I did not want to get into in front of my boss.

Okay, I am in Massachusetts. This company is not licensed in MA to collect debt so they shouldn't even be contacting me. They did contact me, I responded with a DV letter within the 30 days. After they got the DV letter, they continued to call about 4-5 times and they said they didn't get it. It wasn't until I told them who signed for it on the green card and the date they got the DV. They have not called since. They where also on my credit report and I got the results back today. The account remains and it was not updated to show that the debt is disputed.

It would advisable to anyone to always call creditors asking about hardship plans before becoming late on their loans or cards.Remember creditors are easier to deal with than collectors and a 1099c for forgiven debt is not taxable if you qualify for being insolvent per Irs standards.
