Post Chapter 7 - Collections

16 years 6 months ago
Hello All, I am new to the forum - great site! In a nutshell, I had a Chapter 7 discharged in Feb 2009. The process went smoothly and life is much more manageable now. The only "loose end" I have now is a Best Buy account which was part of the discharged debts. The balance was $3900. Prior to the discharge I made a redemption offer to settle the debt. This offer was made to Bass & Associates of Arizona who is handling the debt for ECAST. (Apparently the debt was sold-off by Best Buy.) Neither my attorney nor me received a response.

No DV response and then what questions+

ok say they dont respond to a validation request and you have contested it with the cb. Then what? Can you also get a debt that has a 7 year negative reporting off your record earlier somehow? Also, lets say the sl has expired. Is that the time you send the C&D letter and just wait your 7 years or what? I have been reading the forums but really dont see these answers. Thanks.

Payday loan questions

16 years 6 months ago
I have 8 PDL and just closed my checking account. I owe $4500 in PDL and live in AZ. All of the loans are online. I was paying $900 per paycheck and just can no longer pay the bills. Should I use a debt consolidation service like Langhorne?

Accountable for Mothers Credit Card?

16 years 6 months ago
My mother passed away three yearsa go, but about 1 1/2 years before she did she had me take her to a bank and she opened a checking acct which she had my name put on in case she was hospitalized I could access her funds etc... She applied for a credit card with the same bank, but when she died she left a debt of $8,000plus. Wells Fargo was the bank, and though we provided them with her death certificate and all they said I was now responsible for the credit card she had. (Which btw my brohter was of much help racking it up to that amount I found out later).

2nd Mortgage/Banking Dilemma

16 years 6 months ago
We live in a very small town and bank with a local bank that only has branches in our county. We currently have our checking and 2nd mortgage with this bank. We got the 2nd mortgage 3 years ago and just refinanced it about a month ago when it came due. The problem we are having is that our loan officer/account rep is relentless. Since we changed our checking account to them approx. 8 months ago, we have probably had a total of 10 overdrafts, which I realize is alot, but a flurry of them was from one debit that was processed even though we had stopped it.

Wells Fargo Loan Mod Question

16 years 6 months ago
I applied for a loan mod through Wells Fargo. Got a letter in the mail today with a lowered payment plan for 3 months and then a big balloon payment on the 4th month. Called to ask about this and they said that if you make the three smaller payments on time they will then re-evaluate your financial situation and if it is still in hardship will then grant a loan modification. Does this sound right to you?

Negotiating tactic ???

16 years 6 months ago
I took out a loan with Greenpicket/Northway financial. I've since closed my bank account. They started to call me, threatening wage garnishment, etc. I sent them a letter (text copied from this site, thank you!) telling them it was an illegal loan, I was revoking wage assigment, etc. I got an email stating they are in Malta and governed by their laws (I live in TX). They have waived the interest I owed on the loan. My question is this - can I tell them I am willing to pay the loan, minus the interest I have already paid? Is this one of those "doesn't hurt to ask" questions? TIA!
