vikas I am at a loss as to why there has to be constant put downs in the various threads. It seems as if only people who agree with members and Mods get any answers. anyone who disagrees is called names and told to get off the boards. If this is an open forum , then all opinions and all offers of help should be welcome. There is no need for name calling, hurtful remarks etc. It just makes this board look so uninviting to newbies. I know that this will probably get deleted, and I will be called a shill, a troll, a clown or some other name, but hey , I tried.

What kind of debt would these be considered? Are they open accounts, written, or oral? My sister got a letter from Allied Interstate saying she owed $179 to Columbia House dvd club. I know that she had an account about 5 years ago and returned the dvd's because she did not like the club. Then yesterday she got a letter from Allied Interstate for $179.

If a collection agency is attempting to collect for an illegal payday loan does it make that collection agency culpable for fraud, and if the collection agency violates the FDCPA when they are collecting for an illegal payday lender can they then be considered a "criminal enterprise". any thoughts on this would be appreciated.

I just got served by Chase and have 20 days to respond. I am in North FL and the lawyer for them is in South FL and his name is Philip Orsi. Has anyone had to deal with him or had any luck in court against him. I owe 24,000 on 2 different accounts and don't have enough to settle with at this time. It looks to me like they sent these summons all over the state and just changed the names and addresses. I think they are looking for a default judgement if they do not get an answer from some of the people.

ok so i closed my old account and got a new one. my mistake is not getting a new card. ;( the card i had got linked to my new account. i never expected that CASHBOX would actually use the same card again. they run my card and pulled out few times out on my new account. the nerve of them. they pulled out 200 and then 50 and another 50 and then a hundred. wow!!! thats alot of times. i gave them my card # before, because i went to their legal department and need 2 pay for the balance ihad with them. when that got settled, i did a new loan with them. then i got into default.

anyone know pdl named CASHLAND?? they sent marshall at my fiance's work. now they cant get hold of him, they go to my parents house. i do believe no one can get arrested for a payday loan, right?? can these pdl do that? send cops/marshalls?? and i believe its for a wage garnishing. but why send marshalls?? if he signed the garnishment papers, can he put that on his bankruptcy?? he filed for chapter 7. theyre on process on starting on it. can he add that garnishment thing on his bankruptcy??

Here's a letter I mailed to Portfolio Recovery: Dear Portfolio Recovery, I asked you for validation of a debt you send me bills for. You sent me a typed up memo saying the seller says, I owe $2398.78 and $437 in interest. You can't even tell me who the seller is? or what the debt is for? Or when the debt occurred???? Don't offer an accounting of payments made on the account since you acquired it because I haven't ever paid a dime to your fraudulent company. Long ago, in 1999, I had a defaulted Visa with Capitol One. That visa is SOL in almost every state in the country!!

I am close or at 3 payments behind on a few different cards at the moment and the other day I was having my weekly chat with the Chase rep that called. I have two cards with them; one is 22k and another is 7k. the chase rep told me that I should voluntarily close both accounts as it will look better on my credit report vs. them closing them on me (which he said will happen soon once I've missed 3 or more payments). Anyone familiar with this term/action?

I have always had very good credit, until very recently when I lost my job and my husband's salary was reduced by 15%. I'm working again now, with a very good salary, but now I'm playing catch up. I've got a repayment agreement on my mortgage and my lender has been great. My problem is credit cards. I used a lot of them to help with everyday expenses and I've had several closed due to deliquency. It burns me that I've had stellar credit for 25 years, and bad credit for 4 months, and that's what I'm going to be judged on. How do I clean this up?
