I previously wrote about a refund from a payday lender who had asked me for my drivers license and a fax number to send me papers to sign for my refund. I informed him I did not have access to a fax, so reluctantly he emailed them to me. Now he wants my drivers license. Why would they require that? Also the payday lender is Sign My Loan Has anyone ever received a refund from them? If I do decide to fax them the papers back I will do it from a Kinkos. Do you think this is a scam?

What if you see a listing on your credit report from a Collection Agent, it's been on there since May/June or July... and you've never received any communication from them? Does sending a debt validation letter warrant them responding or else they have to remove it, or how do I go about addressing this? Thanks!

I was very stupid and got a pay day loan, then got into the cycle of getting another to pay the interest on the last one. I am thinking of calling T & C for help is this a good idea? Please help. I live in the state of Illinois and took out a PDL with midland financial for 200.00. They want me to pay 900.00 back. Is this legal according to small loan laws? I have already paid 400.00 to them at this point. Any info would be helpful! Sperl

Back in 2005 there was $20,000 worth of fraud put on two of my Discover Cards. I talked with them and told them it was fraud and they said they would investigate. I kept getting the monthly statements but I refused to pay the minimum which was $300 a month on something that wasnt mine. 3 months went by when I got a call from Zwicker and Associates debt collection company. They said they got the debt from Discover Card and wanted there money. I told them It was fraud, they said they would call Discover back and get back to me. I heard nothing back from either Discover or Zwicker.

I got this piece of junk mail the other day stating I had a pending lawsuit from an OC and the company could help. Confused I went to my local court database and looked up my name and sure enough Mann and Bracken had filed on 8/5/09. It stated a notice was sent to me on 8/13/09 but now its 8/24/09 and I have not gotten anything. Who is responsible for letting me know there is a lawsuit? I do not want to be a default judgement. What if I never get a notification? Should I just go down to the court house and file an intent to defend?

I live in Ohio and they have changed the laws on PDL's. Most of the companies here have changed the way they do business so that they do not have to abide by the new laws. They call them short term loans now. I have defaulted on them and now I am in a mess. I can't afford to pay them back without making payments which they are refusing to let me do. Can anyone help me here???

Well, after clearing up all of my payday loans, I stupidly took out another. I'm trying to find out if Nationwide Cash is licensed in Iowa. I have looked at the Iowa Bank website (linked form this site) and they are not listed, but I'm not sure if they are a dba. The way I read the Iowa law, they need to be licensed in Iowa (not Delaware as stated on their website), correct? Even if they are licensed, they are overcharging by a substantial amount. Thanks.

In the case of Chaudhry v. Gallerizzo, the Fourth Circuit Court of Appeals adopted the standard: "Verification of a debt involves nothing more than the debt collector confirming in writing that the amount being demanded is what the creditor is claiming is owed; the debt collector is not required to keep detailed files of the alleged debt." The Court further stated that a request for validation of the debt is primarily intended to eliminate such problems as collectors contacting the wrong person or attempting to collect debts which have already been paid.
